They might as well pulp this one, too.


This is process 201/07.0GALGS.

A collection of files from this process has been made public. They tell the official history of an investigation: the investigation into the disappearance of Madeleine Beth McCann.

Madeleine was discovered missing at around 10 p.m. on the 3rd of May 2007, in Praia da Luz, Algarve, Portugal. The investigation that followed her disappearance went through several different phases, but what is most perceptive, to anyone who has had the opportunity to study the process files, is a profound split that occurred on the day that her parents, Drs Kate and Gerry McCann, were made arguidos under the terms of Portuguese law.

A book has been prohibited in Portugal this week. It has allegedly been censored because its author caused Madeleine, her parents and her siblings, deep distress, apart from damaging the search for the missing child. What apparently lies at the root of this distress and these damages, is the fact that the author states, in no uncertain terms, the following conclusions that he and an entire team of investigators at the Polícia Judiciária reached, after five months of intense investigation:

“1. The minor, Madeleine McCann, died inside apartment 5A of the Ocean Club, in Vila da Luz, on the evening/night of the 3rd of May, 2007;

2. An abduction was simulated;

3. Kate Healy and Gerald McCann are suspected of being involved in the concealment of their daughter’s cadaver;

4. Death may have resulted from a tragic accident;

5. There are indications of neglect in the guard and safety of their children.”

The McCanns are distressed by these conclusions; it is only natural that they are, and nobody can dispute their right to feel that these are deeply unnerving conclusions, that would send any parent into a state of grave depression.

Nobody can dispute their right to oppose this kind of statement, either. And it would be irresponsible not to respect the decision of an illustrious judge at the Civil Court of Lisbon, who issued an injunction to prevent further publication and sales of the book, in Portugal, as well as the sale of the book’s editing rights anywhere in the world, among other restrictions.

One may not agree with the secretive manner in which the process was dealt with, or with the decision that was reached, but there are mechanisms at the disposal of the entities that suffered this injunction, and it is only up to them to make use of said mechanisms in an attempt to reverse the judge’s ruling.

But there is something else.

There is a process sitting in the archives of the Public Ministry at the court building, in Portimão.

A process that states, in no uncertain terms as well, that a homicide may have put an end to Madeleine’s existence, and that the likelihood of said homicide is high:

“Concerning the other indicated crimes [abduction, homicide, concealment of a cadaver], they are only that, and although the occurrence of a homicide cannot be discarded, due to its high degree of probability, it has to remain a supposition due to a lack of sustaining elements in the files.”

The same process considers the possibility that Kate and Gerry McCann may have been involved in their daughter’s death (“Even though, by hypothesis, one might admit that Gerald and Kate McCann might be responsible for the child’s death (…)”), and it states that several witnesses have most probably lied in their statements, breaking the Portuguese Penal Process Code, under article 132, 1-d:

“Nevertheless, the process files also show that this vigilance [checks on the children], with the periodicity that is mentioned above, was not the one that is alleged in the files, and it remains unexplained why, that night, the checking procedure was altered in the sense of shortening the visit intervals.”

“From the statements of the entire group [the McCann couple and their friends] results a complete incoherence, at the face of which it is easily verified that all of them lie.”

But there are other statements inside this process that any sane person would consider even more distressing, especially when one takes into account what Madeleine’s parents have said, over and over again, live on tape. Here are two examples:

“Despite everything, until a certain moment in the investigation, the [McCann] family sustained and fed the abduction thesis. Nevertheless, at an uncertain date, the family suggested to consult a person that might, eventually, indicate the probable location of little Madeleine’s cadaver. This fact became inexplicable to the members of the investigation, given the fact that it was the family members themselves who raised the possibility of little Maddie’s death.”

“More recently, before Kate McCann’s questioning [on the 6th/7th of September, 2007], in a telephone contact between Gerald McCann and the signatory [inspector Ricardo Paiva], he [Gerald McCann] mentioned, concerning the investigation, that he was certain that the Police didn’t have any evidence that might incriminate them in the death of Madeleine McCann and said that the police was wasting time by directing the investigation towards the parents.”

It doesn’t really get any more explicit than this:

“From all that has been exposed, it results from the file that:

a) The minor Madeleine McCann died in apartment 5A of the Ocean Club in Praia da Luz, on the evening/night of the 3rd of May 2007;

b) an abduction was simulated;

c) in order to render the child’s death before 10 p.m. impossible, a situation of checking on the McCann couple’s children, while they slept, was made up;

d) Kate McCann and Gerald McCann are involved in the concealment of the cadaver of their daughter, Madeleine McCann;

e) at this moment in time, there seem to be no strong indications yet that the child’s death was not the result of a tragic accident;

f) from all that has been established up to this moment, everything indicates that the McCann couple, in auto defence, does not want to hand over the cadaver immediately and voluntarily, and that there is a strong possibility that it was moved from its initial location. This situation may raise questions concerning the circumstances under which the child’s death occurred.”

These are the conclusions that were reached by the team of investigators at the Polícia Judiciária, according to an intercalary report by Chief Inspector Tavares de Almeida, on the 10th of September 2007.

It seems to me that there should have been another request for an injunction, with immediate effect. These conclusions have been distributed by the Public Ministry, on a DVD, and largely published in the Portuguese press, and discussed and commented upon by countless people. Anyone can still request a copy of the process, which contains these highly distressing allegations, at the Public Ministry’s services in Portimão.

I am certain that everyone will agree that they are at least as unnerving and depressing as those that were published by Gonçalo Amaral in his book.

But unfortunately, they cannot be dismissed as the deluded, offensive ramblings of a disgraced, disgruntled cop. They are part of the dossier, and they are not denied anywhere in the process.

Therefore, and until an injunction is issued against Process 201/07.0GALGS, prohibiting anyone from reproducing, commenting upon or discussing these conclusions, we will continue to speak freely about the Portuguese police’s suspicions concerning the Madeleine McCann investigation.

And we may as well start mentioning a homicide, as a likely hypothesis.

  2. I'm no lawyer but I believe that the McCann are to blame for what they say are "unfounded suspicions"; they may have not been charged, but they have not been cleared either - lack of evidence is not the same as NO evidence (like in the case of Robert Murat)...

  7. Just a thought, something which is to me rather curious.

    J. Tanner did not immediately tell Kate and Gerry McCann that she had seen a man carrying a child?

    We are told she did not want to upset them!

    She told Fiona Payne and Rachel Oldfield of this.

    Why did Fiona Payne or Rachael Oldfield on hearing this not tell Kate and Gerry, but merely advised Jane Tanner that it would be a good idea to mention to the police when they arrived.

    If Jane Tanner, Fiona Payne or Rachael Oldfield had told of what they knew immediately, and not WITHHELD this information, pointed those searching for Madeleine in the direction which Jane Tanner saw the man carry a child, then perhaps things would have been different.

    I do not think that J. Tanner by telling Kate and Gerry McCann that she had seen a man carrying a child could have upset them any more than they already were.

    The McCann’s had ALREADY come to the conclusion that A MAN HAD ENTERED THEIR APARTMENT AND ABDUCTED THEIR DAUGHTER.

    To know that someone had information on THIS MAN and could say at WHAT TIME and WHAT DIRECTION he was headed would have surely have been like manna from heaven to the McCann’s?

  8. Fiona Payne in her statement to Leicestershire police -
    She noticed that Kate McCann would put her hands on the twin’s bodies to check their breathing. Fiona Payne thought this odd. Dianne Webster also thought it odd that the twins did not wake through all of the kerfuffle, as did staff members of the O.C.

    Was this true?

    If so -

    Why was Kate checking?

    Did Kate McCann think it was odd for the twins to be sleeping through such mayhem, and thought that an abductor had drugged her babies?
    If so why did, the McCann parents not get this checked out immediately at a clinic/hospital? Surely you would be distraught at the thought of a drug (and what drug) having been used on your children?
    Did Fiona Payne as a concerned friend, medical professional, an anaesthetist, not think to ASK Kate McCann why SHE was constantly checking their breathing?
    Did Fiona Payne as an anaesthetist not think to put, 2 + 2 together, or even hazard a guess that Kate McCann may have been checking the breathing as she, Kate was perhaps thinking the abductor had drugged her babies?
    Why did none of these doctor friends check the twins as far as possible to determine if they had been drugged, before getting them checked out absolutely at a clinic/hospital if the suspicion was that they had been drugged? Let's face it, even us laymen would have thought if our children slept throughout the noise, and this not being the norm (which it doesn't appear to have been as we know of occasions during the holiday when the twins did wake during the night) that there was a possibility that our babies had been drugged, more especially so if a strange man had been in the apartment with our children and abducted one of them!
    Gerry McCann in one of his documentaries stated that his thoughts were that the twins may have been drugged.

    I think I would have woken my babies to be sure they were fine, to hold them close.
    Was it possible that a reason for Kate McCann to constantly check for breathing, that she KNEW the twins had been given 'something' to make them sleep! Was she worried it had been too much? Had Madeleine been given too much, and a sleepy child had fallen and been fatally injured?
    Fiona Payne would not necessarily have given thought at all to the possibility of the children, as Kate's dad had said, being given something at night to keep them asleep.
    Was Kate’s dad correct in what he said?
    You have to ask also. Were the twins both sleeping when Kate arrived at the apartment? IF they had been given something to induce sleep, by Kate was it at this 10:00 pm check, earlier that evening, or both times? A 'top-up' at Ten pm!

  9. Some parents I have heard do this.
    Is it possible one or both twins wakened by say perhaps Madeleine getting out of bed, or when the abductor took her from her bed? Would they have remembered this in the morning, and how well could they speak at age two years to have been able to relate anything of what they may have seen? Some two year olds are pretty smart at speaking!
    Did Madeleine wake when she heard her dad leave the apartment around 9:15 pm got up and fell at this time, as Sr Amaral suggests may have happened?
    What I find strange is that if Kate immediately thought of abduction. Why oh why would she leave the twins alone again to run to the restaurant?
    I could not have left them in the room alone again, much less the apartment.
    The abductor and or accomplices may still have been around.
    Why did she not scoop these children up and take them with her?
    Why did she not as Sr Amaral said, scream at the top of her voice from the balcony area so as not to leave the twins alone?

    The big WHY for me is why did these children NOT get checked out at a hospital or clinic? If I thought for an instant that a paedophile had been in that apartment, had taken my daughter, the next horrible thought would be that he/she had touched my babies.

    At this stage Kate McCann did not know how long any alleged abductor had been in that apartment. He could have been in there for ages doing all sorts of horrible things. Kate McCann did not know of Tanner's sighting at this time, so she had no way of knowing if the abductor had been in there for three minutes or three quarters of an hour since Gerry's check.

    Did Kate McCann run out from the apartment leaving the twins alone and now more vulnerable to alert the others at the tapas, as she knew the twins would be safe as there was no abductor?

    Why were the twins left in their cots for so long afterwards? Maybe I am odd, but as a mum whose daughter had disappeared, I would have the twins in my arms, I'd want them close. Not lying in cots while all of this commotion was going. I would have wanted them taken to a friend’s apartment as soon as possible after having made sure that they had not been harmed by drugs or otherwise for them to be watched over, away from apt 5a if police required me to be there.

    Fiona Payne states that the twins were not taken to her apartment until between 3-4 am the following morning. They did not wake in the cold night air, nor did they wake at any time from whence they were taken from their cots and placed to bed in her apartment.

  10. Fiona Payne said that Kate McCann bashed around the apartment, the police say both McCann’s were down on their knees screaming and punching, howling. One of their friends stated that she could hear this from her apartment from the balcony where she stood.

    We are told too that the police took a long time in arriving. So this screaming, shouting, howling, kicking and punching walls and floors went on for some time, albeit perhaps intermittent. The twins did not wake?

    I appreciate fully that we cannot absolutely say what we ourselves would do in this situation, but I can say what I THINK I would do, and it would be to firstly see to and protect my other babies, not to run around an apartment screaming, shouting kicking and banging. Madeleine and her whereabouts naturally would be my first concern, but as I was NOT out searching as others were, my twin babies would then become my immediate concern, not how I was feeling, but their safety and wellbeing, I would not want to frighten them by running around in this way.

    As parents our children, their safety and wellbeing come first before all else.

    Yet this does not seem to have been the case with the twins.

    Fiona Payne said that although Kate went in and out of the children’s bedroom, she spent a ‘fair’ time just sitting in her own bedroom whilst others checked.

    Would not a mother who had just lost one child, taken by an abductor, who was not going to be out searching personally for her missing child, not want to sit quietly in the bedroom where her other children lay, to watch over them until arrangements were finalised for them to be taken to a place of quiet and safety..

    Fiona Payne tells us and others too that they checked the shutters etc. She said she checked a shutter, not the one in the children’s bedroom as she did not want to wake them, but others did.
    Why, would McCann’s not, once making absolutely sure that their twins had not been harmed by drugs or otherwise, not arrange for the children to be taken to one of the other apartments to be settled and watched over carefully by friends.

    Why were the twins left in their cots for so long afterwards and not taken from the scene of crime, away from 5A?

  11. Kate said in her recent documentary, speaking of when she checked on the children that night before discovering Madeleine was gone, that she did not want to switch the bedroom light on and go into the children’s bedroom as she may wake them?

    Gerry by way of explanation (one of the explanations proffered, there are more than one) as to why they supposedly changed from using the front door to the patio door when checking on their children, was because they feared, by using the front door it would wake the children?

    From this, the impression is very much that these children woke pretty easily at the slightest of noise or at the drop of a light switch!

    We are to believe though that on a cold night lying in a room where the shutter had been open for around 45 minutes cold air blowing, that they did not wake. We are to believe that a man either came in or out of that window, or both, depending which ‘page’ we are on, that these babies did not waken as their sister was carried away?

    After her disappearance, Kate ran around screaming, howling kicking and banging walls, Gerry howling too and all else, that was going on, others in and out of the bedroom, checking of the bedroom shutter etc after Madeleine had disappeared, the twins did not wake?

    I have to say that in light of Kate and Gerry telling us that their concern that their children may wake at the slightest of noise, opening of a door or switching on of a light, that the twins sleeping through mayhem must have been most unusual a circumstance.

    Fiona Payne said that Kate had bruising a day or so after Madeleine disappeared due to kicking punching walls floors etc.

    What if these bruises, if they existed were the result of some other action - like trying to open a heavy metal shutter?

    Did Kate like some of the other tapas group fiddle around with the shutter, any of the shutters to gauge the level of difficulty in doing so?

    According to the Tapas 9, Madeleine was discovered missing around 10pm. The alarm may have been raised around 10pm but many things in the police files point to the 'disappearance' or 'the necessity for disappearance' being known about much earlier by one, some or all of the Tapas 9.

  14. The judge who issued the injunction ought to get her head out of the sand and start reading the official Portuguese investigative account, including the conclusions reached and why.

    The book Dr Amaral has written is based on logic and facts.

    It's the McCanns and their friends who have been pushing this 'abduction' theory with no proof whatsoever.

  15. This should be enough for G Amaral and his publisher to defend the book and the DVD, provided they prove it was implied that those were their reasonable conclusions, not certainties.

    Very clear, unquestionable, what Amaral wrote in his book is in the files, which have been made available to all.

    To me the question that remains is: did the book, TV interviews, or DVD present the conclusions as such, or as facts? If they were presented as facts, and not hypothesis, it would give the Mc Canns ground to sue, in which case they would have all the chances to win their case. I hope Mr Amaral had legal advisors which stopped him from taking unnecessary risks.

    There would be a good well documented article to write for a good English journalist, explaining what is in the files and what Mr Amaral wrote in his book, as this is really an interesting legal case. I doubt that such an article will ever be written.

    Thank you Joana for all your work, and for all the interesting points that you raise. You are helping so much, especially by providing us with relevant information, that the case can't fall into oblivion. What I like most about your site is not only that it is well documented, but also that it is concise, and up to the point.

  17. that mean's that very early, on May 2007, few days after little Maddie died, her prents, to fool not only the police, but the world... SET UP A FUND to ask donnations. Annother crime and that one was not an accident. Was intentional and part of a game which show us how perverted they can be.
    They have no moral to accuse any police, to blame any book.
    They just do that pathetic action against Amaral, one year after the book was published, because they want money. The book became a bestseller and they want this proffits for them.
    We want the Fund checked publicly by independent authorities.

    as nine child sex attacks in the area round Praia da Luz from 2005 to 2007 and the victims included British kids.
    Some happened as close as 20 miles from Praia da Luz, and six of them were on girls between the ages of three and 10.
    He is now investigating leads on six child sex offenders, 78 other rapists and sex attackers and 22 vagrants."

    So PDL is a village in tribal zone of Pakistan, or perhaps of Aphganistan?

  19. People, including the judge who issued the injunction, should be reminded that Kate McCann has still refused to answer over forty questions in relation to the disappearance of her daughter.

    Alarm bells should be ringing loud and clear at that one.

  20. Dr. Amaral and his publishers should have risked publishing the book in the UK in English a long time ago thereby forcing the McCanns to give evidence under oath or take no action. IMO it is far from certain that proceedings would have been instigated by the McCanns and even less certain that the book would have been found to be libelous. Having failed to call the McCanns' bluff on this a great opportunity has been missed. IMO Dr. Amaral has been poorly advised.

    I am not sure your version is entirely correct.

    My understanding is:

    1. Jane Tanner admitted telling one of the other Tapas 9 immediately about the sighting, on hearing that MMC had gone missing.

    2. All the Tapas 9 gang were aware of this sighting - it was noted in the infamous timeline.

    3. GMC and KMC have never denied knowing about the sighting early on.

    At the very least members of the Tapas 9 were aware of the sighting, and as they have all subsequently affirmed, were convinced of its veracity. The fact that none of them then organised a concerted search in the direction of the alleged sighting is incomprehensible - well incomprehensible if you believe that the Pact of Silence folk are giving us an accurate account of the evening's events.

    I think some of what you write might be based on press reports - which cannot be relied upon. From what I recall they had the mark of Mitchell upon them - excuses for inaction.

    Recently in Canada, a white supremicist was taken to court for making alleged hate comments against an ethnic group. The Canadian tribuanal came to a land mark decision that stated the anti-hate / defamatory laws that are currently enshrined in our legal system infringe on one of our other basic right to freedom of expression. The tribunal is not binding to change the law article, only can be applied to this particular case but it has set up a massive precedence and movement to present a legal challenge.

I guess "that" Daved who think Maddye can be hiden in wheareabouts of Algarve for ever and not been noticed, has no idea about Portugal.Maybe he is confusi ng Portugal with the deep USA or Canada!!!!!Portugal is a small country and Algarve has not that unkown places... and, by the way, the refered paedophiles are mainly british who are registered offenders but can roam around world with no warn from british authorities.
