Sábado, dia 12 de Maio 2007 - 9 dias após o alegado rapto

Madeleine Beth McCann nasceu a 12 de Maio de 2003. Encontra-se desaparecida desde o dia 03 de Maio de 2007, facto que ocorreu na Praia da Luz, em Lagos.

É filha de Gerald e Kate McCann e o seu nascimento foi desejado e planeado. No entanto há que referir a dificuldade em a mãe engravidar, resultando os necessários tratamentos e o 'preço' dos mesmos. Veio a nascer de um inseminação 'in vitro', mas face ao ADN traçado da menor, a mesma é filha do casal McCann.

É dado cientifico que os tratamentos médicos para superar algumas das razões da não gravidez aumenta a probabilidade de, numa gravidez, dita normal, nascerem gémeos.

Neste caso podemos ver que uma gravidez, embora desejada e planeada, se transformou numa ia situação familiar de cinco em vez de três pessoas. Depois, cuidar de um filho não é o mesmo que cuidar de três, todos em jovem idade.

Por cerca das 24 h do dia 03 de Maio de 2007, através de ligação telefónica da GNR de Lagos a este Piquete, foi comunicado o desaparecimento de uma menor, cidadã inglesa. Deslocámo-nos para o local para proceder à necessária inspecção judiciária.

Perante o facto, o desaparecimento de uma menor, a investigação ‘desenhou' os diversos quadros possíveis. Desde logo que os pais da menor atribuíram o facto (desaparecimento) a uma acção de terceiros, defendendo o RAPTO.

Muito embora fosse um dos cenários possíveis, os procedimentos da família foram de modo a conduzir nessa direcção, através de um acção de publicidade do facto de um modo nunca antes visto.

Na verdade, no dia seguinte, as televisões inglesas ao "abrirem" os seus noticiários já publicitavam o desaparecimento / rapto da menor. A defesa deste cenário foi, para a comunicação social, a 'verdade' dos factos em investigação.

O tempo decorreu sem que tal cenário se confirmasse no 'cumprimento' dos seus pressupostos. Nunca foi apresentada qualquer tipo de pedido de resgate em troca de informações ou da própria criança. Porém e face ao depoimento de um dos amigos, Jane Tanner, poderíamos estar perante tal quadro.

Entretanto as diligências continuavam de modo a recolher todo o tipo de informação e sempre na perspectiva de se poder trabalhar todos cenários, ainda, possíveis.

A informação recolhida, de inicio, junto dos familiares e amigos foi incerta e “trabalhada”, pelo grupo, de modo a dar força à versão apresentada e defendida.

Seguido a versão dos pais e do GRUPO, foram jantar e todos deixaram os filhos, a dormir, nos respectivos apartamentos.

Os elementos do grupo efectuaram uma reunião em que acordaram determinadas regras que sustentavam uma versão de acompanhamento contínuo das crianças, enquanto jantavam.

Encontra-se junto aos autos, um manuscrito de um elemento do grupo que dá, consistência a esta tese.

Estes princípios que, deste modo, foram partilhados por todo o grupo leva a que perante a opinião pública inglesa todo o GRUPO esteja sempre ilibado, impossibilitando qualquer acontecimento anormal que pudesse superar os trinta minutos, uma vez que todos concordaram ser esse o tempo em que foram realizadas vigilâncias às crianças

A versão de que alguém do grupo , de 15 em 15 ou de 30 em 30 minutos se deslocava aos apartamentos para verificarem de que tudo estava bem, cai por terra !!

Das declarações de todo o GRUPO resulta um total incoerência, face à qual se verifica, facilmente que todos mentem.

Podemos verificar que um dos elementos do grupo querendo dar consistência à versão grupal da vigilância, lhe dá um toque pessoal: as verificações às crianças eram efectuadas de duas maneiras, uma, só para ouvir se alguma chorava e em caso de silêncio tudo estava bem e a outra verificando mesmo.

Na sua vez de verificar as crianças, um dos elementos do grupo, o Matthew, terá feito assim, pois até disse à Kate que estava tudo bem, não especificando. A Kate lembra-se deste pormenor.

A verdade , no entanto, é que esta informação leva a investigação a vaguear, a perder tempo e recursos.

Não é entendível que esta informação seja prestada de inicio e mantida ao longo de todo o tempo, apesar de, qualquer um, poder verificar os prejuízos daí resultantes para a investigação.

Volvido todo este tempo a versão mantém-se !! a par da afirmação pública e martelada de que o que mais querem é "ajudar a investigação”.

A investigação teve de assumir a incorrecção da informação e sair em frente.

Daqui só !! resulta:
Se alguém foi ver as crianças e estava tudo bem o desaparecimento verificou-se entre as 21.30 e as 22 horas;

Se a informação não contasse com tal testemunha (?) então o desaparecimento ocorreu entre as 21.00 e as 2200 h, alargando o período (partindo do principio de que o pai fala verdade).

Há no entanto uma outra questão sobre o horário, que é:
A última vez que a criança foi vista fora do GRUPO, por alguém que possa provar esse momento, foi por cerca das 17.35, horas, quando os pais a foram buscar ao infantário / creche, o que poderá aumentar o hiato de tempo, entre o desaparecimento e o alerta, para quatro horas.

Na continuação da análise à informação prestada temos que um dos elementos do GRUPO veio a ser uma testemunha, pretensamente importante, Jane Tanner, pelo que nos transmitiu: VIU alguém à hora do jantar atravessar a rua: do local do desaparecimento, na direcção da casa de Robert Murat.

Esta informação direccionou e ocupou o trabalho dos investigadores durante largo tempo. Este pode ser o exemplo de como uma informação que não é correcta pode , não só atrasar, como pode ter levado à perda da menina.

Através de insistência na informação vieram-se a traçar cenários de desconformidade da mesma com a realidade, mas que não impediu a realização de um trabalho demorado e intenso à volta daquele arguido.

De igual modo podemos verificar a discrepância sobre o assunto nas declarações de Gerald e da Jane. Como passaram a escassos dois / três metros um pelo outro e não se viram; podem posicionar-se num espaço tão reduzido, entre ambos não conseguem ver a mesma pessoa a passar; melhor um vê e outro não.

Mesmo o local onde, supostamente, se teriam cruzado não é muito bem definido por ambos.


Aqui faço um pequeno intervalo no relatório e introduzo um extracto do testemunho, bem como o croqui, de Jane Tanner, feito no dia 4 de Maio de 2007, que descreve o alegado avistamento do raptor. É este o testemunho que serve de base à tese do rapto, defendida pelos McCann e o grupo.



(...)Normalmente em cada 15 minutos uma pessoa de cada apartamento vai aos quartos (1) das respectivos filhos para ver se está tudo bem com eles. Durante o jantar tudo correu bem. As pessoas estavam bem dispostas. Recorda-se que, pelas 21h10m, o Gerald McCann saiu do Restaurante (3) tendo ido ao apartamento para ver as crianças. Cinco minutos depois saiu a depoente, tendo-se deslocado ao seu apartamento para verificar se estava tudo bem com as suas filhas. Nessa altura reparou no Gerald McCann a falar um cidadão inglês, de nome Jez, que conheceram nestas férias. Jogava ténis com eles. Passou por eles sabendo que o Gerald McCann já tinha estado no apartamento (1) a ver os filhos. Entretanto reparou num homem (*) a passar com uma criança ao colo (**) com um passo apressado, tendo sido esse pormenor juntamente com o facto de a criança estar vestida com um pijama sem estar "embrulhada" com uma manta, que lhe chamou a atenção. Só o conseguiu ver de lado com a criança nos seus braços. Apercebeu-se da presença do indivíduo exactamente quando acabou de passar pelo Gerald McCann e o Jez, que conversavam, tendo visto essa pessoa a sair do passeio que delimita o bloco de apartamento (1) onde residem, tendo rapidamente atravessado o cruzamento A entrada do prédio de apartamentos (1) faz-se exactamente no local (rua) de onde apareceu o referido indivíduo. Após ter ido ver os filhos regressou as Restaurante. No regresso o Gerald McCann já não se encontrava a conversar no local onde o tinha visto. Quando chegou ao Restaurante (3) já estava o Gerald McCann acompanhado da sua mulher Kate Healy.(...)

Mais tarde no relatório final da PJ será dito o seguinte: «A proximidade física, real e efectiva entre Jane Tanner, Gerald McCann e Jeremy Wilkins, no momento em que a primeira passou por eles, e que coincidiu com o avistamento do suposto suspeito, transportando uma criança. Resulta, a nosso ver, inusitado que tanto Gerald McCann como Jeremy Wilkins, não a terem visto, nem ao alegado raptor, apesar da exiguidade do espaço».


O momento escolhido pelo testemunha Jane para prestar a informação do que tinha 'visto' e a explicação para tal momento é irreal, ou seja não será facilmente aceitável que qualquer testemunha (do grupo) ao ver alguém com uma criança ao colo afastar-se da casa dos McCann, não tenha, imediatamente, agido ou falado, sendo certo que a própria descrição da pessoa vai sendo sucessivamente alterada e “aperfeiçoada". Não resulta, assim, grande credibilidade neste depoimento.

Até ao momento estivemos na análise de pequenas distorções na informação inicialmente transmitida, verificando-se 'pequenas' alterações à verdade relacionando-as com a investigação e a direcção a que obrigaram.

A investigação não andou a mando nem ao sabor de quem quer que fosse: a informação familiar e 'grupal' que neste tipo de crime é fundamental, foi sempre distorcida.

Face ao facto das pessoas serem estrangeiras impediu, até hoje, uma recolha de informação directa sobre as pessoas do GRUPO.

Os pais da menor vivem numa sociedade, a inglesa, conhecida através da imprensa em caso relatados, com muito exigente. A profissão de ambos a medicina, completado pelo facto do pai ser cirurgião, faz aumentar este grau de exigência e o consequente cansaço.

Numa sociedade identificada, a inglesa, internacional e mediaticamente, como exigente e com muitas e apertados regras para determinar essa 'exigência' obrigará a que as pessoas descansem; façam uma paragem profissional: gozem férias.

A profissão de Gerald McCann é a de cirurgião cárdio vascular.
Em muitos momentos da sua carreira profissional teve de decidir em milésimos de segundo, o que lhe 'atribui' uma frieza e, certamente, provoca um cansaço acrescido.

O gozo de um período de férias supõe um descanso, através de práticas não usuais e de uma liberdade e isenção de horários.

A vida social num tal período de férias, no caso presente, é facilitado pelo facto de terem viajado em grupo.

Mas essa vida social pode, de algum modo, ser tocada pela presença e necessidades de acompanhamento, constante, dos menores.

Este facto e necessidade constata-se através da entrega dos filhos nos respectivos infantários e creches (adequados às respectivas idades). O tempo de férias não é partilhado entre os pais e os filhos.

O DIA 03 de Maio de 2007 tinha decorrido, até cerca da hora do jantar, de um modo natural face ao tipo adoptado. Após terem ido buscar os filhos ao infantário e à creche dirigiram-se para o Apartamento, pouco depois das 17.35 h. Mas... a Kate foi correr meia hora à praia e depois foi para o apartamento e .... o Gerald foi jogar ténis.

Enquanto durou o jogo de ténis apareceu um elemento do grupo que esteve em contacto com a Kate, no apartamento num período de tempo que terá mediado entra os 30 segundos, segundo a versão da Kate, e os 30 minutos, segundo a versão do Gerald.

Em trinta segundos podemos perguntar se está tudo bem e se é necessário algo, pouco mais. Em trinta minutos podemos avançar e fazer algo que necessitem de nós.. ...

Deitaram e adormeceram os menores, por cerca das 19.30 h. Mantiveram-se em casa até cerca das 20.30 h indo de seguida para o restaurante ' O Tapas'. Do grupo foram os primeiros o chegar.

Após estar todo o grupo à mesa, e a dar inicio à refeição, começaram as " visitas” às crianças de um modo que não é coerente nem aceitável, não podendo ser confirmado e que só o grupo defende, no tipo 'versão única'.

Embora afirmem nos autos que a sua posição estratégica no restaurante ‘O Tapas’ lhes permitia, a eles McCann, ver o apartamento onde deixaram os seus filhos, menores, a dormir, pelo exame ao local afigura-se falso.

De notar, ainda, pelo exposto nos autos que tudo aponta para que a posição na mesa era de costas voltadas para o apartamento.


Para entenderem qual a "visão" possível do apartamento, onde os McCann deixaram os três filhos, todos com menos de 4 anos na noite de 3 de Maio de 2007, apresento a fotografia 1 que mostra onde os McCann e o grupo de amigos estavam sentados a jantar e a fotografia 2 que demonstra a impossibilidade de se poder vigiar as crianças, ou fosse o que fosse desde o "Tapas".





Naquela NOITE, por cerca das 22.05 h, segundo a versão da mesma, foi a vez da Kate se dirigir ao apartamento para verificar a crianças, coincidindo com o fim do jantar, ao qual tinha chegada por cerca das 20.30 h.

Voltou, assim, ao apartamento cerca de uma hora e meia depois, espaço de tempo durante o qual esteve sem ver os seus filhos.

Demorou cerca de 10 minutos !!. Depois apareceu no restaurante e comunicou aos restantes elementos o desaparecimento da filha Madeleine.

De notar que a Kate bem sabia que, deslocando-se como o fez novamente ao restaurante deixaria os dois gémeos, Amelie e Sean, na mesma situação de perigo.

Não se compreende que não tenha utilizado o telemóvel para chamar o Geral ou o grupo ou, mais simples, que tivesse vindo à varanda de onde poderia ser perfeitamente audível pelos elementos do grupo.

As autoridades, GNR, foram alertadas par cerca das 22.40 h e foram encetadas, pelos populares alertados, buscas para procurar a menor.

A divulgação dos factos não se ficaram pelas autoridades e pelas difusões normais. No dia seguinte canais de televisão ingleses e portugueses noticiam o facto.

No entanto o GRUPO esteve reunido. A procura ter-se-á circunscrito ao interior do apartamento.

Antes de qualquer busca efectuada pelas órgãos policiais aos arredores já corria a notícia do eventual rapto.

Por questões, dizem, de aconselhamento e apoio os pais solicitaram a presença de um padre, por cerca das 02.00 / 03.00 horas do dia 04 de Maio.

Das declarações informais que prestaram, durante a inspecção judiciária no local as informações desde logo induziram à tese do RAPTO.

Coisas simples tornaram-se em desinformação: a questão da janela aberta ou fechada; o estore aberto ou fechado; a porta da varanda aberta .... a porta de entrada do apartamento, no trinco ou fechada.

Apesar de tudo, até determinada altura da investigação a família sustentou e alimentou a tese do rapto. Contudo, em data não precisa foi sugerido pela família que fosse consultada uma pessoa que poderia, eventualmente, indicar o provável sítio onde se poderia encontrar o cadáver da menina Madeleine.

Este facto tornou-se inexplicável aos elementos da investigação uma vez que foram os próprios elementos da família a levantar a hipótese da morte da pequena Maddie.

Apesar de tudo perante a comunicação social continuavam / continuaram (e continuam) a declarar a esperança que têm de encontrar a filha viva: a primeira vez que se levantou a hipótese da menina estar morta é, efectivamente, sugerida pelo casal McCann.

Mantendo, embora, em aberto várias linhas de investigação foi decidido avançar na vertente de efectuar uma nova inspecção ao local de onde desapareceu a menina.

A técnica de inspecção é vulgarmente usada no Reino Unido e consiste na utilização de dois cães especialmente treinados.

Como é natural o olfacto dos animais é o 'sentido' usado. No caso deste 'sentido' a diferença entre o homem e o cão é de 5 milhões de células para 200 milhões de células. De salientar o facto de o recurso a este tipo de inspecção, no UK, é frequente e a percentagem de êxito é de cem por cento.

Um dos cães está treinado para detectar odor de cadáver e o outro para identificar vestígios de sangue humano.

Realçamos neste momento que a localização de odores de cadáveres significa que fisicamente o corpo (cadáver) não se encontra no local, marcado pelo cão, mas seguramente ali esteve, desde que o cão o sinalize.

Conforme se verifica dos respectivos autos, constantes do inquérito os cães efectuaram inspecções cinotécnicas nos locais, abaixo, identificados e nos objectos descritos, com os resultados indicados.

As inspecções foram todas gravadas em som e imagem e foram dirigidas pelos colegas ingleses que acompanham os cães.

Neste grande número de objectos e locais inspeccionados os cães vieram a ter comportamento de identificação, "marcação”, nos seguintes locais e objectos:

1. apartamento 5 A, resort do Ocean Club, local de onde desapareceu a menina:
1.1 cão de odor de cadáver:
* no quarto do casal, num canto, junto do roupeiro;
* na sala de estar, por detrás do sofá, junto da janela lateral da apartamento;

1.2 cão de sangue:
* na sala de estar, por detrás do sofá, junto da janela lateral do apartamento (exactamente o mesmo local assinalado pelo cão que sinaliza odor de cadáver);

2. zona de quintal fronteira ao apartamento 5A:
2.1 cão de odor de cadáver:
* num dos canteiros, sendo comentado pelo treinador a ‘ligeireza’ do odor detectado;

3. apartamentos onde estiveram hospedados os restantes elementos do GRUPO:
* NADA foi detectado por qualquer dos cães;

4. casa actual (à data) do casal McCann:
* NADA foi detectado, na casa, por qualquer dos cães;

5. na localidade Aldeia da Luz:
* NADA foi detectado por qualquer dos cães;



6. às roupas e pertences da família McCann:
6.1 cão de odor de cadáver:
* em duas peças de roupa da Kate McCann
* numa peça de roupa da menor Madeleine
* no peluche da menor Madeleine
* foi detectado o odor de cadáver, quando o peluche ainda se encontrava no interior da residência (à data da família).
* foi confirmado em condições fora da casa;

7. o veículo usado pela família McCann:
7.1 cão de odor de cadáver:
* marcou a chave do veículo;
* marcou no interior da bagageiro do veiculo;
7.2 cão de sangue:
* marcou a chave do veículo;
* marcou no interior da bagageira do veículo;

8. veículo usado por um amiga da família, que esteve hospedado no mesmo aldeamento, coincidindo alguns dos dias:
* NADA foi detectado por qualquer dos cães;

9. todos os veículos usados pelo arguido Robert Murat e pessoas que lhe estão próximas:
* NADA foi detectado por qualquer dos cães.

(num total de dez veículos o cão de odor de cadáver e o de odor de sangue apenas fizeram marcação no veículo da família McCann, alugado a 27 de Maio !!! )

Os locais e peças marcados e sinalizados pelo cão de sangue encontram-se a ser sujeitas à realização de exames, parte dos quais se encontram concluídos.



Não menos relevante se torna o apuramento dos resultados que apontam ADN de Madeleine como presente no local do apartamento 5 A, por detrás do sofá, local marcado pelo cão de odor de cadáver e, assim, também pelo cão de sangue.

Em todos os locais marcados pelo cão de sangue o laboratório veio a confirmar existir ADN.

O relevo mediático dado ao caso e a procura de informação por parte da comunicação social tem levada a uma evolução nas declarações dos pais da menor Madeleine.

Toda a informação que tem vindo a público, tem contribuído para a remontagem da história, adaptando-a a eventuais questões policiais e tentando justificar os indícios e consequente prova que se vai recolhendo.

Vejamos: a comunicação social aventou a hipótese das crianças terem sido 'sedadas' para ficarem a dormir e permitir algum descanso aos pais.

Temporalmente distante o pai de Kate, e avô da menor, Brian Healy admite à Comunicação social que a Kate poderá ter dado um medicamento, de nome Calpol, para ajudar a menina (os meninos ? ! ) a dormir, ao contrário do que a sua filha Kate tem afirmado.

A Kate, através do elemento, da PJ, de ligação à família, veio perguntar a razão pela qual não tinham sido recolhidas amostras aos gémeos de modo a despistar a hipótese. Bem sabia que, na altura tinham já decorrido mais de três meses e que segundo especialistas na matéria inviabiliza tal exame.

Foi mais longe nessa afirmação dizendo que poderíamos - investigação – verificar que o raptor tinha sedado a Madeleine, para consumar o seu acto e também tinha sedado os gémeos.... para consumar o seu acto ... porém não o disse no momento propício.

Certo como sabemos, é que os sedativos possuem tempos de acção e tempos para serem expelidos, que varia entre as seis e as duzentas horas.

As valências médicas, do casal McCann, são suficientes para terem conhecimento deste dado científico, mesmo que nunca na sua actividade profissional tenham realizado trabalhos de toxicologia.

Quando a comunicação social informou que tinha sido 'detectado sangue no carro e apartamento' a Kate e membros da família vieram a público com a desculpa simples de ter sido alguém, com acesso ao apartamento. o colocar as provas.

Agora admitem mesmo ter sido o órgão de investigação criminal a colocar provas 'falsas' ( sangue e odores de cadáver no apartamento e veículo )

A Kate, na tentativa de justificação do sangue, terá ido mais longe, informando, nessa ocasião que, a Madeleine tinha , por vezes, hemorragias nasais.

No dia em que foi efectuada a busca domiciliária, na casa do casal McCann , no quarto do casal foram encontrados escritos, mas também uma bíblia, escrita em língua inglesa. Estava aberta nas páginas de que se juntam cópias, com a respectiva tradução.


«Então disse Davi a Natã: Pequei contra o Senhor. Tornou Natã a Davi: Também o Senhor perdoou o teu pecado; não morreras. Todavia, porquanto com este feito deste lugar a que os inimigos do Senhor blasfemem, o filho que te nasceu certamente morrerá. Então Natã foi para sua casa. Depois o Senhor feriu a criança que a mulher de Urias dera a Davi, de sorte que adoeceu gravemente. Davi, pois, buscou a Deus pela criança, e observou rigoroso jejum e, recolhendo-se, passava a noite toda prostrado sobre a terra. Então os anciãos da sua casa se puseram ao lado dele para o fazerem levantar-se da terra; porém ele não quis, nem comeu com eles. 18 Ao sétimo dia a criança morreu(...)Samuel 12:13»

O RAPTO é uma situação com a qual, no Reino Unido, infelizmente muito da opinião pública se encontra familiarizada, devido à 'cota' deste tipo de crime.

Pessoas inteligentes deveriam ter o conhecimento mínimo de que a publicidade é prejudicial à investigação de um crime de rapto e sobretudo à segurança da pessoa que foi raptada.

Deveriam esperar pelos decisões das autoridades policiais, havendo fortes indícios de que alteram a cena do crime, mexendo em alguns móveis.

As alterações são indicadores de simulação.

Na noite do desaparecimento da menina Madeleine a família foi contactada por uma senhora que se identificou com documentos que a credenciavam como pessoa que trabalha com menores no Reino Unido.

Identificou-se com os documentos / credenciais em uso no Reino Unido, junto de hospitais e centros de atendimento de menores. Dispôs-se a ajudar no que fosse necessário. Sem qualquer dúvida esta pessoa podia ter sido uma ajuda, até quanto a procedimentos, mas foi dispensada.

De todo o apurado, os factos apontam no sentido de que a morte de Madeleine McCann ocorreu, na noite de 03 de Maio de 2007, no interior do apartamento 5A, do resort Ocean Club da Praia da Luz, ocupado pelo casal McCann e pelos três filhos;

Verifica-se coincidência entre a sinalização de odor de cadáver e sangue, conforme o Relatório Laboratorial (parcial) já junto aos Autos;

Tal sinalização, ocorreu por detrás do sofá da sala (odor de cadáver / sangue / ADN), o que indubitavelmente prova que tal móvel foi obviamente encostado por alguém, após a verificação da morte de Madeleine McCann. Face aos poucos indicias recolhidos no local e sujeitos a exame, é de admitir a forte hipótese de ter o mesmo sido sujeito a "lavagem” no momento seguinte à ocorrência da morte;



De igual modo, o peluche utilizado pela menina morta, encontrado à cabeceira da cama onde normalmente dormia (vide fotos de inspecção inicial) revela que alguém a ali colocou em momento posterior à morte, uma vez que a própria cama nada tem de odor de cadáver. Isto é, ocorreu uma modificação intencional, no sentido de simular um quadro não correspondente à realidade, numa tentativa de aproveitamento para a simulação de quadro de rapto;

Acrescenta-se ainda que o cão de odor de cadáver sinalizou fortemente o quarto onde o casal McCann dormia, o que pode indiciar a deslocação do corpo do local da morte (sala de estar), para zona não visível em tal quarto;

Acresce que uma nova forte marcação de odor de cadáver foi efectuada em roupas de Kate McCann, o que pode indiciar que a mesma esteve em contacto com o cadáver;

Igualmente existe forte marcação de odor de cadáver no carro utilizado pelo casal McCann (desde 27 de Maio de 2007), o que conjugado com a marcação do cão de sangue e fundamentado em análises laboratoriais, constantes nos Autos, que indicam a presença de ADN da menor Madeleine McCann na bagageira da viatura, são de forma a não excluir a forte hipótese que esta viatura possa ter sido utilizada para um eventual translado do cadáver, após 24 dias da ocorrência da morte;

Não é de desprezar a indicação do cão de odor de cadáver, bem como do cão de sangue, na chave do veículo atrás referido, vindo o laboratório a confirmar a existência de ADN de Gerald McCann. Acrescenta-se que esta última sinalização foi conseguida pelos cães após a chave ter sido colocada longe do veículo e em local não visível.

Por todo o exposto, RESULTA dos Autos QUE:

A) a menor Madeleine McCann morreu no apartamento 5 A do Ocean Club da Praia da Luz, na noite de 03 de Maio de 2007;

B) ocorreu uma simulação de rapto;

C) de forma a impossibilitar a morte da menor antes das 22H00, foi inventada uma situação de vigilância das crianças do casal McCann enquanto dormiam;

D) Kate McCann e Gerald McCann estão envolvidos na ocultação do cadáver da sua filha Madeleine McCann;

E) neste momento, parece não existirem ainda fortes indícios de que a morte da menor não tenha ocorrido devido a um trágico acidente;

F) do apurado até ao momento, tudo indica que o casal McCann, como autodefesa, não queira fazer a entrega de forma imediata e voluntária do cadáver, existindo uma forte probabilidade de o mesmo ter sido transladado do local inicial de deposição. Esta situação é susceptível de levantar questões quanto às circunstâncias em que ocorreu a morte da menor.

Assim, sugere-se a remessa dos Autos ao Exm.º Sr. Procurador da República, no círculo de Lagos, PARA:

G) eventual novo interrogatório dos arguidos Kate e Gerald McCann;

H) avaliar da aplicação de medida de coacção que se julgar adequada ao caso.

Tendo-se no decurso da busca domiciliária à residência do casal McCann, encontrado um manuscrito tipo diário, já fotocopiado, possivelmente de autoria de Kate McCan; admitindo-se que o mesmo possa conter elementos que permitam atingir a verdade material dos factos, PROPÕE-SE QUE:

I) as fotocópias daquele documento sejam presentes ao M.mo Juiz tendo em vista a sua apreensão, se legal, tradução e eventual recolha de elementos a carrear para os autos, por necessários à investigação.

Face a todo o exposto, nesta data, submeto os autos à vossa apreciação para que determine o que tiver por conveniente, pelo que abro:

English translation of the Intercalary Report at The Maddie Case Files

For the attention of the
Criminal Investigation Coordinator

Madeleine Beth Maccann was born on the 12th of May 2003.
She has been missing since the 3rd of May 2007, a fact that took place in Praia da Luz, in Lagos.

She is the daughter of Gerald and Kate McCann and her birth was desired and planned.
The mother’s difficulty in becoming pregnant should nevertheless be mentioned, as well as the resulting necessary treatments and the ‘cost’ thereof.
She was born from ‘in vitro’ insemination, but the tracing of the child’s DNA shows that she is in fact the McCann couple’s daughter.

It is a scientific fact that the medical treatments to overcome some of the causes for the lack of pregnancy increase the likelihood of twins being born from a so-called normal pregnancy.

In this case, we can see that a pregnancy, although desired and planned, turned a family of three into a family of five.
Moreover, caring for one child is not the same as caring for three, all of tender age.

At around midnight on the 3rd of May 2007, through a phone connection between the GNR in Lagos and this police station, the disappearance of a child, an English subject, was communicated.

We went on location in order to perform the necessary judiciary inspection.

Faced with the fact, the disappearance of a child, the investigation “drew out” the various possible scenarios.

The child’s parents immediately attributed the fact (disappearance) to the action of a third party, defending the ABDUCTION.

While [abduction] being one of the possible scenarios, the family’s actions led into that direction, by publicising the fact in a manner that had never been seen before.

In fact, on the very next day, English television stations ‘opened’ their newscasts, already advertising the child’s disappearance / abduction.

The defence of this scenario was the ‘truth’ of the facts under investigation, for the media.

Time went by and that scenario was not confirmed as its presuppositions were not ‘fulfilled’. No ransom was ever demanded in exchange for information or for the child itself.
Nevertheless, and considering the deposition by one of the friends, Jane Tanner, we could be looking at said scenario.

Meanwhile, diligences continued in order to collect all kinds of information and always with the purpose of working all scenarios that were still a possibility.

The information that was initially collected with family and friends was uncertain and had been “worked” upon by the group, in order to strengthen the version that had been presented and defended.

According to the version of the parents and of the GROUP, they went out to dine and all of them left their children, asleep, in their apartments.

The group’s members held a meeting during which they agreed on certain rules that sustained a version of continuous checking of the children, while they dined.

The process includes a manuscript by one of the group’s members that supports this thesis.

These principles, which in this manner, have been shared by the entire group, have the effect that for the English public opinion the whole GROUP is always cleared, rendering any abnormal event that might last longer than 30 minutes impossible, given the fact that they all agreed that was the time lapse in which the children were checked.

The version that someone from the group went to the apartments to check that everything was well, every 15 or 30 minutes, collapses!!

Total incoherence results from the GROUP’s statements, which makes it easy to verify that everyone lies.

We can verify that one of the group’s elements, wishing to make the group’s version about the checking, more consistent, gives it a personal touch: the checks on the children were carried out in two manners, one just to listen if anyone was crying, and in case of silence all was well, and the other one by actually checking.

On his turn to check on the children, one of the group’s elements, Matthew, did just that, as he even told Kate that all was well, with no further explanation. Kate recalls this detail.

But the truth is that this information leads the investigation to wander about, to waste time and resources.

It is not understandable that this information is given at the beginning and sustained throughout time, despite the fact that anyone can verify the damage that results from it, for the investigation.

After all this time, the version is upheld !! as well as the public, insistent statement that what they want most is to “assist the investigation”.

The investigation was forced to assume the information was incorrect, and move forward.

This only!! results in:

If someone checked on the children and all was well, the disappearance took place between 9.30 and 10 p.m.;

If the information wouldn’t be counting on said witness (?), then the disappearance would have taken place between 9 and 10 p.m., widening the time period (presuming that the father speaks the truth).

But there is another question about the timing which is:

The last time that the child was seen outside of the group, by someone who can prove that moment, was at around 5.35 p.m., when the parents went to pick her up at the crèche, which may widen the time lapse between the disappearance and the alert, into four hours.

Continuing to analyse the information that was offered, we have one of the group’s members, Jane Tanner, becoming a supposedly important witness, due to what she told us: she saw someone crossing the street at dinner time: from the location of the disappearance into the direction of Robert Murat’s house.

This information directed and occupied the investigators’ work for a long time. This may be an example of how information that is not correct, may not only delay, but may have led to losing the little girl.

By insisting on the information, scenarios were outlined which failed to match said information with reality, but still long and intense work was carried out on that arguido.

In the same manner, we can verify the discrepancy about the subject, in statements from Gerald and Jane. How they passed each other at only two or three meters’ distance, yet failed to see each other; can they position themselves in such a reduced space, and both fail to see the same person walking by; more correctly, one sees and the other doesn’t.

Even the location where they supposedly crossed ways is not very well defined by both.

The moment chosen by the witness Jane to make her statement about what she had “seen” and the explanation for that moment is unreal, which is to say, it is not easy to accept that any witness (from the group) upon seeing someone with a child in the arms getting away from the McCann’s place, hadn’t immediately acted or spoken, being certain that the description of the person was being consecutively altered, “perfected”. Therefore, there isn’t much credibility in this deposition.

Until now we have been analyzing small distortions in the information that was initially transmitted, “small” alterations (distortions) of the truth taking place, thus relating them with the investigation and with the direction it forced it into.

The investigation didn’t follow the command or the will of anyone; the family and group information that is fundamental in this type of crime, was always distorted.

The fact that the individuals were foreigners prevented, until now, that direct information about the persons of the GROUP could be collected.

The parents of the minor live in a society, the British, known through the press, as being very demanding. The profession of both parents, medicine, completed by the fact that the father is a surgeon, increases this degree of demand and consequent tiredness.

In a society that is identified internationally and in the Media as being very demanding and with many and tight rules to establish those standards of exigency, it makes it obligatory that people rest; make a professional retreat; take their holidays.

Gerald McCann is a cardiovascular surgeon.

In many moments of his professional career he had to make decisions in thousandths of a second, which ‘gives’ him a certain coldness, and certainly provokes an increased tiredness.

The enjoyment of a period of holidays supposes a rest through non-ordinary practices and freedom and exemption from schedules.

The social life in such a holiday, in the present case, was facilitated by the fact that they travelled as a group.

But that social life may, in a certain way, be touched by the presence and constant needs of accompanying the minors.

This fact and need was clear in the deliverance of the children to the respective child centres and crèches (according to their ages). The holiday time was not shared between parents and children.

The 3rd of May of 2007 had gone by, until around dinner time, in a natural way according to the adopted style.
After fetching the children from the nursery and the crèche they went to the apartment, shortly after 17:35h.
But…Kate went running for half an hour on the beach and then went to the apartment and…Gerald went to play tennis.

While the tennis match was taking place, another member of the group, who had been in touch with Kate, in the apartment, for a period of time that took between 30 seconds, according to Kate, and 30 minutes, according to Gerald, showed up.

In thirty seconds we may ask if everything is well and if anything is needed, little more.
In thirty minutes we can go ahead and do something that is requested from us…

They put the minors to bed and to sleep, at around 19:30h. They remained at home until around 20:30h, going to the Tapas restaurant afterwards. They were the first to arrive, out of the group.

After the entire group was at the table and when the meal started, the “checks” on the children began, in a way that is neither coherent nor acceptable; it could not be confirmed and only the group defends it, in a sort of “unique version”.

Although they say in their statements that their strategic position in the Tapas restaurant allowed them, the McCanns, to see the apartment where they’d left their underage children asleep, the examination of the spot reveals it is false.

It must be noted, also, that according to the investigation. everything points to their position at the table being with their backs to the apartment.

On that NIGHT, around 22:05h, according to her version, it was Kate that went to the apartment to check the children, coinciding with the end of the dinner, at which she had arrived at around 20:30h.

So, she returned to the apartment about one and a half hours later, the time lapse during which she didn’t see her children.

It took her about 10 minutes!!. She then showed up at the restaurant and told the remaining members about the disappearance of her daughter Madeleine.

It must be noted that Kate knew that, going back to the restaurant as she did, she would leave the twins, Amelie and Sean, in the same dangerous situation.

It is not understandable why she didn’t use the mobile phone to call Gerald or the group or, even simpler, that she didn’t walk out on the balcony from where she could be perfectly heard by the members of the group.

The authorities, the GNR, were alerted at around 22:40h, and the alerted population started the searches for the child.

The divulgation of the facts wasn’t kept within the authorities and the normal channels. On the following day, British and Portuguese televisions were broadcasting the news.

However, the GROUP had been reunited. The search was circumscribed to the interior of the apartment.

Even before any search by the authorities in the surroundings started, the news about the possible abduction was already running along.

By reasons, they said, of counselling and support, the parents asked for the presence of a priest, at around 02:00h/03:00h on the 04th of May.

From the informal depositions they gave, during the judiciary inspection on location, the information immediately induced the thesis of ABDUCTION.

Simple things became disinformation: the question of the open or closed window; the shutter up or down; the open balcony door…the front door, merely shut or locked by key.

Despite everything, until a certain time in the investigation, the family sustained and fed the theory of abduction. However, on a date that cannot be precise it was suggested by the family that a person should be consulted that could, eventually, indicate the probable location of little Madeleine’s cadaver.

This fact became inexplicable to the members of the investigation, given the fact that it was the members of the family themselves who raised the hypothesis little Maddie’s death.

Nevertheless, for the media they continued (and continue) to declare their hope of finding their daughter alive: the first time that the hypothesis of the little girl’s death was raised it was, effectively, suggested by the McCann couple.

While keeping several investigation lines open, it was decided to advance in the direction of a new inspection of the spot where the girl disappeared.

The inspection technique is commonly used in the United Kingdom and consists of the use of especially trained dogs.

Naturally, the dog’s smelling sense is the ‘sense’ at use. In the case of this ‘sense’, the difference between the human and the dog is of 5 million cells to 200 million cells.
It must be highlighted that the use to this kind of inspection is frequent in the UK and the success rate is of 100%.

One of the dogs is trained to detect cadaver odour and the other to identify traces of human blood.

We now stress that the location of the cadaver odours signifies that physically the body (cadaver) is not on the place, marked by the dog, but certainly it has been there, as long as the dog signals it.

As can be read in the process files, in this inquiry, the dogs inspected the following locations and items, with the results described below.

All the inspections were recorded in sound and image and were directed by our British colleagues that accompany the dogs.

Among the great number of items and locations that were inspected, the dogs marked the following locations and items:

1. Apartment 5 A, Ocean Club resort, the place from where the child disappeared
1.1. Cadaver odour detection dog:

* master bedroom, in a corner, by the wardrobe
* living room, behind the sofa, by the side window

1.2. Blood dog:

* living room behind the sofa, by the side window (exactly the same spot that had been signalled by the cadaver dog);

2. Front garden of apartment 5A:
2.1. Cadaver odour detection dog:

* one of the flower beds (the dog handler commented on the “lightness” of the odour)

3. Apartments where the rest of the group were staying:

* NOTHING was detected by the dogs

4. McCanns’ present residence (at that time):

* NOTHING was detected in the house by any of the dogs

5. In Aldeia da Luz village:

* NOTHING was detected by any of the dogs

6. McCann family’s clothes and belongings:
6.1. Cadaver odour detection dog:

* two pieces of clothing belonging to Kate McCann
* one piece of clothing belonging to Madeleine
* Madeleine’s soft toy
* the cadaver odour was detected when the toy was still inside the residence (the McCanns’, at that date)
* it was confirmed under out of the house conditions

7. The vehicle that was used by the McCann family:
7.1. Cadaver odour detection dog:

* marked the car key
* marked the inside of the car boot

7.2. Blood dog:

* marked the car key
* marked the inside of the car boot

8. Car that was used by a family friend that was staying in the same resort, on some of the same days :

* nothing was detected by any of the dogs

9. All the cars that were used by arguido Robert Murat and the people that are close to him:

* nothing was detected by any of the dogs.

(In a total of 10 cars the cadaver dog and the blood dog only marked the car of the McCann family, rented on the 27th of May!!!)


The locations and items that were marked and signalled by the blood dog are being subject to forensic exams, part of which are already concluded.

Not less relevant is the refinement of the results that point towards Madeleine’s DNA as being present in apartment 5A, behind the sofa, a spot that was marked by the cadaver and the blood dog. In every place marked by the blood dog, the laboratory confirmed that DNA was present.

The media attention that has been given to the case and the search for information by said media has led to an evolution in Madeleine’s parents’ statements.

All the information that was made public, has contributed to the rebuilding of the story, adapting it to eventual police questions, and to attempts to justify the indicia and consequent evidence that is being collected.

Let’s see: the media suggested the possibility that the children could have been sedated to be kept asleep and allow the parents some rest.

Distant in time, Kate’s father, the grandfather of the child, Brian Healy, admits to the press that Kate could have administered some medication to the little girl, Calpol, to help the child (the children??) to sleep, contrary to what his daughter Kate has been stating.

Kate, through the PJ inspector that acted as “liaison” with the family, asked why samples weren’t taken from the twins in order to test that hypothesis. She knew well enough at that time, more than 3 months later, that such an exam would be worthless.

She went even further and said that we – the investigation – should verify that the abductor had sedated Madeleine, in order to accomplish his action and that he had also sedated the twins…to consummate the act…however she didn’t say that at the right moment.

What we certainly know is that the sedatives have timings to act and timings to be expelled, that vary between six and 200 hours.
The McCanns’ medical knowledge is enough to know this, even if their professional activity never included performing toxicology exams.

When the media informed that blood had been detected “in the car and in the apartment”, Kate and members of her family come to the public with the simple excuse that it had been someone, who had access to the apartment, that had placed the evidence.

Now they even admit it was the criminal investigation body that placed the “false” evidence (blood and cadaver odour in the apartment and in the car).

In an attempt to justify the blood, Kate went even further, informing, on that occasion, that Madeleine sometimes suffered nosebleeds.

On the day that the house search was performed, at the McCanns’ residence, written papers were found in the master bedroom, as well as a bible, written in English. It was open on the pages whose copies are annexed to this report, with the translation.

ABDUCTION is a situation with which, unfortunately, in the United Kingdom, most of the public opinion is acquainted, due to the rate of this kind of crime.

Intelligent people should have a minimum of knowledge that publicity damages the investigation of an abduction crime and is especially threatening to the safety of the abducted person.

They should wait for the decisions from the police authorities; there is strong evidence that the crime scene was altered, and some furniture was moved around.

Those changes are indications of simulation.

On the night that little Madeleine disappeared, the family was contacted by a lady that identified herself with documents that credited her as somebody that worked with minors in the United Kingdom.

She identified herself with documents/certifications that are used in the UK, with hospitals and child care centres. She offered her help in whatever was needed.
No doubt this person could have been of valuable help, even about procedures, but she was dismissed.

From everything that was established, the facts point in the direction that the death of Madeleine McCann occurred, on the night of May 3rd of 2007, inside apartment 5A, at the Ocean Club resort in Praia da Luz, which was occupied by the McCann couple and by their three children;

There is a coincidence between the marking of cadaver odour and blood, according to the (partial) Laboratory Report that has been annexed to the process files.

Said marking occurred behind the living room sofa (cadaver odour / blood / DNA), which indubitably proves that said piece of furniture was pushed back by someone, after the death of Madeleine McCann was verified. Because of the few traces that were recovered on location and subject to examination, it has to be admitted as a strong hypothesis that it was subject to a “washing”, at a moment following the occurrence of death.

In the same manner, the soft toy that was used by the dead child, which was found at the top of the bed where she usually slept (cf. photos from the initial inspection) reveals that someone put it there at a moment posterior to death, given the fact that the bed doesn’t have any cadaver odour. This is to say, an intentional modification took place, in order to simulate a “picture” that doesn’t match reality, in an attempt to take advantage for the simulation of an abduction scenario;

It must be added that the cadaver odour detection dog strongly signalled the bedroom where the McCann couple slept, which may indicate the moving of the corpse from the actual death spot (living room) into a non visible part of said bedroom;

Furthermore a strong marking of cadaver odour was made on Kate McCann’s clothes, which may indicate that she was in touch with the cadaver;

There was also a strong marking of cadaver odour in the car that was used by the McCann couple (since the 27th of May 2007), which in conjugation with the blood dog’s marking and based on the forensics that are included in the process files, which indicate the presence of Madeleine McCann’s DNA in the car boot, lead towards not excluding a strong hypothesis that this vehicle may have possibly been used move the cadaver, 24 days after the death;

The indication from the cadaver odour detection dog, as well as from the blood detection dog, on the key of the aforementioned vehicle, where the laboratory would confirm the existence of Gerald McCann’s DNA, cannot be dismissed. This last signalling was obtained by the dogs after the key was put far away from the vehicle, in a non visible location.

From everything that is exposed, the process files result in the following:

A) the minor Madeleine McCann died in apartment 5A at the Ocean Club resort in Praia da Luz, on the night of the 3rd of May 2007;

B) a simulation of an abduction took place;

C) in order to render the child’s death impossible before 22H00, a situation of checking of the McCann couple’s children while they slept was made up;

D) Kate McCann and Gerald McCann are involved in the concealment of the cadaver of their daughter, Madeleine McCann;

E) at this moment, there seem to be no strong indications that the child’s death was not the result of a tragic accident, yet;

F) from what has been established up to now, everything indicates that the McCann couple, in self-defence, doesn’t want to deliver the cadaver immediately and voluntarily, and there is a strong possibility that it was moved from the initial place of deposition. This situation may raise questions concerning the circumstances in which the death of the child took place.

Therefore, we suggest that the case files are sent to the Republic’s Prosecutor, in the Lagos legal district, for:

G) a possible new questioning of the arguidos Kate and Gerald McCann;

H) an evaluation of the measure of restraint to be applied in this case;


During the house search at the McCann couple’s residence, a diary style manuscript was found, already photocopied, possibly authored by Kate McCann; admitting that it may contain information that may help to reach the material truth of facts, WE PROPOSE THAT:

I) the photocopies of said document are presented to the illustrious Judge for the purpose of its apprehension, if legal, its translation and eventual collection of information to be included in the process files, as necessary for the investigation.

At this date, I subject the case files to your appreciation, for you to determine whatever you may see as convenient, hence I open:


CONCLUSION

    Post after post the British Public screaming for this woman to go to prison for neglect. I do not remember this response when the Mccanns did the very same thing, and this women did not have a child 'abducted'. Then the Mccanns are Doctors ...my question, who should have known better?

    Someone heard a child calling 'Mummy Mummy' from a window...

    If only Mrs Fenn had been a busy body on the 1st May and called the police when she heard a child screaming 'Daddy daddy'. Madeleine may well be here today.

  5. The photos of the walls of Number 5 show spatters of "body fluid" labelled.
    The photo of the floor of Number 5 shows bloodstains between the tiles under the sofa (some tiles have been removed.Where are these tiles now?) These photos are in the Truth of the Lie book - but they are from THE OFFICIAL FILES.
    No-one else who ever hired that apartment has recorded any accident to cover these finds.(I have no record for this assertion, do not have the book at present.)

  6. That's pretty clear even to me and I don't claim to understand a lot of Portuguese.
    But what is the use of publishing it to people who would rather close their eyes and ears to the truth than admit that "two of their own" are responsible for the death of one of their children under four years of age?
    Those screaming loudest for the woman to go to jail for neglect mentioned by Ironside are also those most vociferous when it comes to defending the McCanns. Perhaps they should reflect on the fact that all that woman's children are alive; all, not just two out of three. Will the British professional lifestyle class ever realise that children are vulnerable and require protection irrespective of where they live or who their parents are?
    I doubt it, there isn't even the realisation in Britain that a discussion of this whole area of child neglect and responsible parenting is long overdue. When it comes to children the British class system is far worse than any form of racism.

  11. You mean the case is solved by conclusion and not evidence? It's a pity that this conclusion that you have quoted, in short, in English has no substance. No evidence, no substance. No substance then a calculated speculation is what it is. It's a pity for you then that a conclusion cannot charge, judge and sentence a suspect. Otherwise the McCanns would not be free and considered innocent right now.

    Give me the facts of what crime has been committed and the evidence then we will have a more informed conclusion.

    I'll quote once again the LAWFUL conclusion. That conclusion backed by Portuguese law. It's in the files and saved as a document entitled 'Legal Summary'

    Any amount of personal opinion about what neglect is will not add value or remove it from the word of the law.

    They were not charged with neglect because they could not be convicted of neglect as they did not intend to abandon the children and that is proved by the providence of a reasonable level of care and the fact that they were not charged.

    The pattern of the blood splatter on the side wall is interesting as it appears in the form of an arch with a symmetry to it. It looks like it is child height, but who knows the actual height of it!

    And would the distance from the wall to the blood under the tile correspond with the height of the blood splatter?

  19. Oh don't get too excited there! The 3 arguidos were arguidos no more, for want of evidence to lay charges...but that's not to say no evidence exists...! Crimes sometimes take years, decades to be solved - all while generation after generation waits for The Evidence. So swing it how you want: we're still waiting for Evidence. Evidence that Madeleine was abducted is YET to surface. So let's all wait for that evidence of abduction too then?

    But this for sure is certain: A Chain is Only as Strong as its Weakest Link.

    None of the forensic tests showed Madeleine's DNA. There has been mention of 15 out of 19 Alleles matching Madeleine's DNA found in the car, but John Lowe of the Forensics institute explains that it was in fact 15 out of 37 Alleles as the DNA was from at least 3 people and could have come from her parents who share 50% of Madeleine's DNA.

  22. I just had a thought about that last day when some people think Madeleine might not have attended nursery school because she was no more,(although there were signatures signing her in and out).

    Correct me if I am wrong, but wasn't that the day the children went on a boat trip.

    If so, then Madeleine would also have been there, so surely there would have been photos, perhaps taken by parents of their children who also went on that outing or taken by the teachers.

    Have those parents been contacted by the investigators, because they must have a list of their names, and they could ask if they took any pictures of that day and the group of children.

    If Madeleine is not amongst them on the boat, well, where was she?

    I hope the McCanns didn't get to the parents first being as how they themselves were subsequently arguidos and the case now shelved, waiting to be reopened.

    The McCanns, and the people who have been working for them, should not have been allowed to interfere in any way with the case, and that includes that visit by their financial supporter to Robert Murrat and to Mr Smith.

    They do all this right under the noses of the police as well, although isn't it supposed to be illegal to carry out a private investigation of a police case in Portugal.

    I think it depends on the law where the ‘neglect’ happened whether it is what the McCanns did was neglect or not. I think this is what Tony Bennett discovered when he tried to bring an action; that the 'neglect' did not happen in England/Wales meant it could not be tried in and English court (I am sure I will be corrected if I have misinterpreted the reasons why the case was primarily thrown out).

    According to the NSPCC in the UK it certainly would have been:

    There’s no legal age limit for leaving a child on their own, but it’s an offence to do so if it places them at risk. Parents can be prosecuted for neglect if they leave their children unsupervised “in a manner likely to cause unnecessary suffering or injury to health”. (Children and Young Persons Act).

    Clearly, even assuming what the McCanns say happened, Madeline was placed at risk otherwise she would not be missing.

    The recent case of Rebecca Stevenson (mentioned elsewhere) shows this to be the case even though it appears here children came to no long-term physical harm.

  27. From what was writen on Inspector Tavares report, made available to the public and not removed, dismissed or contra-argued by the PGR or somebody at the top of PJ, we can assume:

    - The huge team of Pj and British police believe, got evidences and know's Madeleine is dead and died somewhere in late afternoon or early night of May 3,2007, when she was on the care of at least one of her parents.

    - The judges have the same opinion as the polices, this is why they made the Mccann's arguidos, ask the bank and credit cards accounts and the medical reports of Maddie and Kate.

    - The PGR arrived at the same conclusion as the polices and the judges. this is why he send the Rogatory letters to UK, setted a new team of inspectors headed by Paulo Rebelo, which followed the same track as Amaral, in the investigation and takes more then a year to shelve the case and lift the arguidos status. Wonder to see how many pressures he try to fight without success because he cannot go against the PM. One year, for me, was one year of war between the government and the top justice departments with their work being prevented by the British authorities which delayed or refused to help the investigation. The Lab report was a charade as the Tapas7 Interrogatory made by Leicester police.

    - For the polices, the judges and the PGR, the abduction was a fake abduction, made to cover-up an accident or possible crime with no doubts, a single objective: avoid and prevent an autopsy.

    - For the Judges and the PGR, the case was shelved and not closed. The arguidos status of the Mccann's were lifted due to pressures but their condition as suspects remain the same. Even, after more then 20 years the case can be re-openned and charges made. tHIS WILL HAPEN AS SOON AS THE GOVERNMENT CHANGE IN pORTUGAL OR/and UK, or the justice system break down in Portugal exposing all the corruption.     If somebody from the Lab said that, this means, the samples have been contaminated in the Lab... By an accident or intentional?
    Use your brain, if there were not ADN, why the PGR send the Rogatory letters to UK and a team including Paulo Rebelo and a Forensic expert to discuss the forensic evidences with the Lab workers? Amaral was not incharged of the investigation at the time.

    The dogs are not dismissed from the British police. Up to now... not any previous case were the dogs have been involved, was re-openned, re-evaluated and changed. The dogs, presented to the world as the top ones with 100% of accuracy, found human blood and a human cadaver sent in Mccann's flat, car and clothes. Also in the cuddle cat. Somebody died in 5A flat and a human body was carried in the Renault Scenic. If was not Madeleine... who was that misterious body which no any relatives claim missed?

    Use your brain... In an investigation, ADN is just one more evidence to add at many others which have an important rule in the crime. Taking into account that the crime scene was contaminated by the Mccann's, the ADN was less important then the unconsistent statments made by the Mccann's and their refuse to do the reconstuction or to answer vital questions. This became the key which made them suspects and the all abduction theory, a LIE!!

  29. Hello Jamar, most of us in Britain, take good care of our children and our pets. The McCanns, tried to justify their cruel behaviour in PDL, by saying it was the British way of life to go out and leave their children in the way they (the McCanns) did.

    My children, (when they were young) were never left alone, when my husband and I went out. Whether it was during the day or in the evening. None of my family or friends ever left their children alone.

    There are good and bad parents throughout the world, but in my opinion, there are more good parents than bad.

    The McCanns have a lot to answer for with the slurs they have left on both Portugal and the UK, and their portrayal of us.

    That is the way many people think of us now, with Portugal full of child abductors on every corner waiting to grab a child in the night, and that it is normal for UK parents to leave their kids by themselves while they go out for the night. Just one of our little customs of course!!

    It is always somebody else to blame with the McCanns, never them.

    According to Gerry, they had even contacted a lawyer from the get go who told them they had done nothing wrong.

  31. From this report one can conclude one thing, someone died in apartment 5A. Previous to Madeleine's death no one else had died there. The apartment was cleaned on a daily basis, under the tiles human blood in decomposition was found, those DNA traces found were a match to Madeleine's profile. Cadaverine odour was signaled by trained dogs used in several operations, with an expert record, in various objects and clothes belonging to the McCanns.

    The case should be reopened and every diligence that was left undone, like the police reconstruction with the whole group, should be followed through, until every avenue of the investigation has been exhausted.

    It doesn't matter if it's a joint investigation, a British investigation, a Portuguese investigation, an Interpol or Europol - the case needs to be investigated until the truth of what happened to this child is found.

    A missing child case should never be archived,under no circumstances, nor by political pressures, the case has to be re-opened.

You wouldn't believe the garbage that Fox channel has televised with regard to this case. The Fox channel is all about promoting their agendas, they conveniently ignore the facts.

    Given the length of time that it took for the final laboratory results to reach Portugal coupled with the strange behaviour of the British government, I am dubious that the actual results of the English lab were sent to Portugal. Based on the recent strange comments made by one of the McCann detectives regarding the PJ not having used low copy method on the DNA samples, I think that the McCann team is worried that the PJ has retained some extra samples.

    Regardless of the DNA, like Joana Morais said, a dead body was present in that apartment. Since no one had died before in that apartment then who else could it be?

  34. I think that I am correct in saying that the initial DNA tests were conclusive, as far as UK law anyway, and would probably have resulted in a conviction in the UK.

    However, following retesting, and no doubt interference from the British government, the samples *somehow* became contaminated, and inconclusive.

    I sincerely hope that the PJ did keep back up samples that may be tested somewhere independently and away from the effects of the corrupt British government. They have interfered in every aspect of this investigation, and are still doing so.

    As to Jim Gamble, I suspect if he really is doing his job, if he does get close, he will be stopped in his tracks. This corruption goes right to the top I'm sure.

    I have actually heard people on Fox news discussing this case and sounding like they have serious doubts about the abduction theory.

    That is why I suggested them.

    Since then, the McCanns have been referred to on this network mentioning their 'we have been found innocent of all charges' rubbish.

    That is the problem, that 'arguido' status is not understood by those with a different legal system, and it is making it easy for McCanns to say that as they are no longer arguidos this means they are no longer suspects because they have been cleared and are innocent.

    This is happening in the UK as well. Over and over people are saying this when talking about the McCanns. The spin that they have been found innocent of all charges, when there have been no charges.

    To be quite honest it would have been better if there had been no such arguido status, as it is easy to be giving people the wrong impression when it has been lifted, and the McCanns never fail to use this as some sort of proof of innocence of any guilt whatsoever, as if there had already been a trial.

    It's mistakes like that which misrepresent the facts. Forensics could not determine if the odour was actual cadaverine or not.

I ask because I thought it was written and handed to the police when they arrived at the scene, however it mentions Jane Tanner's 'sighting' of a man carrying a child which if I recall correctly she didn't discuss with Kate or Gerry and in fact only with one female member of the group, either Rachel or Fiona. Can someone enlighten me please?

    Her toothbrush and hairbrush had been got rid of by the McCanns, and there was no trace of her in the apartment, so they had to rely on Gerry going back to Rothley for the pillowcase which he said was Madeleine's.

    Very trusting of them, given the circumstances.

    There was a lot of confusion about this so called DNA, even with claims that if it was Madeleine's then Gerry could not be her father. Yet Gerry insists he is.

    That is why I ask, have they ever had Madeleine's DNA to begin with?

    If they could find Madeleine's body, then they would really have her PERSONAL DNA to test against the forensic material they found, but of course her body has vanished so this is not possible.

He was wearing golden beige cloth trousers (linen type) with a "Duffy" type coat (but not very thick). He was wearing black shoes, of a conventional style and was walking quickly. He was carrying a sleeping child in his arms across his chest. By his manner, the man gave her the impression that he was not a tourist.

    (**) Concerning the child, who seemed to be asleep, she only saw the legs. The child seemed to be bigger than a baby. It had no shoes on, was dressed in light-colored cotton pajamas (perhaps pink or white) It is uncertain, but the interviewee has the feeling that she saw a design on the pajamas like flowers, but is not certain about it.

    Concerning these details, the interviewee states not having known what Madeleine was wearing when she disappeared. She has not spoken to anyone about this. Concerning the man, she has only mentioned it to Gerald, but without going into details and with the police. The interviewee has been invited to draw a sketch which we attach to this document.

    This is a very accurate description for saying the man was visible for only a few seconds in very subdued lighting and from a distance of 50 meters, it beggars belief that anyone could notice so many things in such a short time and throw in the distance and lighting I would say absolutely impossible to see such detail.
    I would like to see her in the reconstruction and even manage to recall the color of his shoes with accuracy never mind anything else he was wearing.
    No wonder they did not want to go back, it would have blown the story to bits.

  42. ModNRocker at 36. I agree but it seems some people don't actually want to either read the FSS report, or if they do, blame it on contamination or Govt intervention because it doesn't back up their theory.

    First in order to find out what happened we have to look at the evidence and then formulate a theory based on that evidence. We don't start with our theory based on how we feel personally about the McCanns and then look for evidence to back it up or state the lack of evidence must mean corruption.

    I don't particularly care for the McCanns one way or the other. What I am interested in is justice for Madeleine and finding out what happened and for that I look to EVIDENCE and not my own prejudices.

    Thank you. What I really want to know is whose handwriting is that on the timeline on Madeleine's book. I am no expert but in my opinion it is a man's writing and should be easy to establish whose it is (that may already be done but I'm not aware). If I am right then we can narrow it down to Gerry, David, Matthew or Russell. What is clear is whomever wrote it and whoever else helped to collect that data from the group were 'aware' of Jane Tanners 'sighting' of a supposed abductor. Which would then beg the questions of why first of all they didn't all set off in hot pursuance and why Jane said she didn't discuss the 'sighting' with Kate and Gerry. Joana do you recall any information about who actually wrote it, is it clear in the police files?

    Obviously, there must have been enough information to make the PJ conclude that Madeleine is dead and the McCanns somehow involved.

    They do not believe in the abduction as there is no evidence for that.

    Conclusion to that, we cannot discard what the PJ believe because they know a whole lot more than we do and they are convinced Madeleine is no more.

    Who are we to contradict them when they are the official investigators.

    Dr Amaral is not saying anything that the other detectives who worked on the case don't agree with, so are the McCanns going to sue them as well?

    Some of the PJ (Tavares and Amaral) may not believe abduction but none of them know what happened that night, because as the Prosecutors have concluded, there is no evidence the McCanns committed a crime.

Maybe you should read the rest of it, like for example the bit about the reconstitution that the McCanns' friends, always so helpful and so concerned about Madeleine's welfare, REFUSED to attend. Now pay attention, especially as far as the McCanns "innocence" is described:

    Taking into account that there were certain points in the arguidos’ and witnesses’ statements that revealed, apparently at least, contradiction or that lacked physical confirmation, it was decided to carry out the “reconstitution of the fact”, a diligence that is consecrated in article 150 of the Penal Process Code in the sense of duly clarifying, on the very location of the facts , the following very important details, among others:

    1 – The physical, real and effective proximity between Jane Tanner, Gerald McCann and Jeremy Wilkins, at the moment when the first person walked by them, and which coincided with the sighting of the supposed suspect, carrying a child. It results, in our perspective, strange that neither Gerald McCann nor Jeremy Wilkins saw her, or the alleged abductor, despite the exiguity of the space and the peacefulness of the area;

    2 – The situation concerning the window to the bedroom where Madeleine slept, together with the twins, which was open, according to Kate. It seemed then necessary to clarify if there was a draught, since movement of the curtains and pressure under the bedroom door are mentioned, which, eventually, could be verified through the reconstitution;

    3 – The establishment of a timeline and of a line of effective checking on the minors that were left alone in the apartments, given that, if it is believed that such checking was as tight as the witnesses and the arguidos describe it, it would be, at least, very difficult to reunite conditions for the introduction of an abductor in the residence and the posterior exit of said abductor, with the child, namely through a window with scarce space. It is added that the supposed abductor could only pass, through that window, holding the minor in a different position (vertical) from the one that witness JANE TANNER saw (horizontal);

    4 – What happened during the time lapse between approximately 6.45/7 p.m. – the time at which MADELEINE was seen for the last time, in her apartment, by a different person (David Payne) from her parents or siblings – and the time at which the disappearance is reported by Kate Healy – at around 10 p.m.;

  48. 5 – The obvious and well-known advantages of immediate appreciation of evidence, or in other words, the fulfilment of the principle of contiguity of evidence in order to form a conviction, as firm as possible, about what was seen by Jane Tanner and the other interposers, and, eventually, to dismiss once and for all any doubts that may subsist concerning the innocence of the missing [child’s] parents.

    In this sense, the legal procedures were followed, according to the norms and conventions that are in force, and the appearance of the witnesses was requested, inviting them to be present inclusively appealing to solidarity with the McCann couple, as it is certain that since the beginning they adhered to that process diligence.

    Nevertheless, despite national authorities assuming all measures to render their trip to Portugal viable, for unknown motives, after the many doubts that they raised about the necessity and opportunity of their trip were clarified several times, they chose not to attend, which rendered the diligence inviable.

    We believe that the main damage was caused to the McCann arguidos, who lost the possibility to prove what they have protested since they were constituted arguidos: their innocence towards the fateful event; the investigation was also disturbed, because said facts remain unclear.

    Let me rephrase that for you: by having their friends, oops, by permitting that their friends refused to attend the reconstitution, the McCanns LOST THE OPPORTUNITY TO PROVE THEIR INNOCENCE.

    There is no need for sarcasm.
    I have read the whole thing (which is why I pasted a link to it). I have not said the McCanns/Tapas7 are paragons of virtue to be held up on a pedastal for their parenting skills. Or that they have co-operated fully with the investigation etc! (And BTW it is not up to anyone to prove their innocence in a case, it's up to the investigators to collect evidence that the prosecution can then use to lead to a guilty verdict).

    However which way you look at it, the PROSECUTORS who read the whole file, and had access to ALL the info in the PJ files, still came to the conclusion that there was NO EVIDENCE OF ANY CRIME committed by the McCanns and Murat. If others want to read the files and come to a different conclusion to that of the Prosecutors, then that is their perogative, but it may well be the wrong one because the PJ files are incomplete and they may lack the knowledge and understanding of Portuguese law amongst other things to understand the information contained in those files.
