Demonstração de Apoio ao Gonçalo Amaral


Pelo Direito à Liberdade de Expressão, pela Democracia, por Portugal

A liberdade de expressão é um direito constitucional inalienável, pelo qual o povo português lutou arduamente e que não pode ser posto em causa, nomeadamente quando exercido com responsabilidade e respeitando a lei.

No dia 9 de Setembro de 2009, Portugal tomou conhecimento, através da comunicação social, de uma ocorrência gravíssima neste país que tanto lutou pela Democracia: um acto de censura contra um livro.

O livro “Maddie: A Verdade da Mentira” foi sujeito a uma providência cautelar que visou, não apenas a suspensão da venda do livro e do DVD baseado na obra, mas também de toda e qualquer divulgação da tese veiculada pelo Dr. Gonçalo Amaral, autor do livro e ex-coordenador da Polícia Judiciária, sobre o caso ‘Madeleine McCann’.

Com este acto, bania-se não apenas a obra escrita, mas todo um pensamento: a expressão de uma opinião, baseada em factos de uma investigação policial; uma conclusão racional, responsável e adulta.

No entanto, tal providência cautelar era apenas a ponta de um icebergue. Na acção principal a que se refere, os pais de Madeleine visam extorquir ao Dr. Gonçalo Amaral a soma de 1.2 milhões de euros – um valor astronómico e fora de qualquer proporção, seja legal, seja ético.

Uma segunda providência cautelar viria ainda apreender bens e vencimentos ao requerido, manietando a sua capacidade de resposta em termos financeiros, uma vez que as custas judiciais e de processo se encontram indexadas ao valor exigido na acção principal. Desta forma, sem capacidade de livre expressão e economicamente asfixiado, completa-se o cerco a um Homem que tem procurado, com elevado custo pessoal e familiar, única e exclusivamente a reabertura de um processo judicial, para que se possa concluir uma investigação que muitos consideram ter ficado aquém das suas potencialidades.

O Dr. Gonçalo Amaral não pode falar. Mas nós, Cidadãos Portugueses, podemos falar por ele.

Podemos falar, e podemos agir.

Agir na defesa da liberdade de expressão, direito constitucional que entendemos inalienável, sobretudo quando é exercido de forma responsável e madura.

Agir no apoio a quem se vê privado de meios para se defender legalmente, na sequência de manobras deliberadas por parte de quem visa a sua destruição, pessoal e profissional.

Agir porque hoje a vítima da mordaça da censura é o Dr. Gonçalo Amaral – amanhã poderá ser qualquer um de nós..

Pelo exercício de uma cidadania livre, firme e responsável, não nos calaremos. Junte-se a nós!

No próximo dia 11 de Dezembro a partir das 9h45 em frente ao Palácio da Justiça, Lisboa, ao cimo do Parque Eduardo VII, 7ª Vara - 2ª Secção. Traga uma Mordaça.

  4. Espero que os portugueses se unam em torno desta causa. FOMOS INSULTADOS, DIFAMADOS, de cada vez que estes Mccann ou alguem em seu nome abriram a boca sem que os politicos portugueses os responsabilizassem e exigissem um pedido de desculpas. Durante mais de 2 anos, vimos a imagem de Portugal e dos portugueses publicitada por todo o mundo como sendo ninho de pedofilos e raptores, gente maltrapilha, sem caracter, sem instrucao/educacao, comedores de sardinhas incompetentes. Durante 2 anos fomos meros espectadores num circo que transformou a justica portuguesa numa palhacada e trouxe de volta a censura e as mordacas, como se elas fizessem parte das democracias modernas e podessem apagar direitos constitucionalmente garantidos. Vimos advogados portugueses venderem-se e venderem o pais numa historia tao pouco honrosa para quem defende os direitos fundamentais das criancas. Em Inglaterra, quando Amaral, xenofobamente e sem provas, foi insultado, nenhum advogado ingles aceitou defende-lo. Em Portugal, 2 pais fortemente negligentes, de cuja negligencia resultou o desaparecimento da filha, sao defendidos por advogados de topo, provavelmente recomendados por altas figuras do estado, mesmo que para todos os efeitos permanecam como principais suspeitos sobre o que tera acontecido a filha. NAO HA QUALQUER PROVA DE RAPTO. Os mccann nunca foram ilibados porque nao o podiam ser, pois nao foram julgados. Em temos legais continuam como em Setembro de 2007- SUSPEITOS, RESPONSAVEIS POR UM FUNDO FRAUDULENTO, UMA INVESTIGACAO PRIVADA FRAUDULENTA E A TOTAL OBSTRUCAO A JUSTICA E A INVESTIGACAO.

    NAO FIQUE EM CASA, SE ESTA PROXIMO DE LISBOA, JUNTE-SE A QUEM LUTA PELA DIGNIDADE E POR PORTUGAL!

  5. Oh to be able to join you in Lisbon on Friday. I wish you all strength. You are not only supporting Sr Amaral but also Portugal and the Freedom of Speech throughout the world.

    Whilst I do not quite understand the meaning of this hearing, when Sr Amaral is successful in his defence (now or in the future defamation case) does that leave the way open for Sr Amaral to fight back and to have an action against the McCanns? We were all led to believe a counter-action was being prepared. The problem is that the McCann PR team would spin the story about the heartless detective stealing the money to search for Maddie by a vindictive law suit. It seems to me either way Sr Amaral will be painted as the bad guy.

    I urge the Portuguese PR company assisting the McCanns, for the good of your countryman and of your country, give up this appointment. Your reputation will suffer in your country if you carry on, short term monetary gain is no use when all your fellow countrymen and businesses avoid you.

There is no need to point out over and over again that the ruling of the Portuguese court against Gonçalo Amaral and his book is a clear violation of Art. 37 Portuguese Constitution and therefore illegal. However, it cannot be pointed out often enough that the fact that such ruling is possible in Portugal based on the claim the judge in question allegedly checked the evidence, read Amaral's book and the final PJ report and therefore decided to rule in favour of the McCanns, is not only jeopardizing the fundamental rights of every Portuguese citizen, but also a severe blow against democracy. An unbiased judge could not have come to such conclusions. Plaintiff McCanns case would have been dismissed. And there is still more to it. The same judge pretends jurisdiction outside Portugal by mailing the preliminary decision to foreign publishing houses, demanding to cease and desist from selling Amaral's book and also requesting the royalties and monies from the sale of the book in question to be withheld from Amaral and transferred to a bank account with the court. This is illegal as well! Gonçalo Amaral was not even officially notofioed about this measure and the Portuguese judge attempts to confiscate his financial assets abroad by pretending jurisdiction. This is a crime in itself, and in every decent country where there is an unbiased and functional judicial system a judge who acts like this one did, would be fired on the spot! The silence of the Portuguese government in this case is also telling. And Carter-Ruck continues to cheat people with by mailing out requests to cease and desists to international internet providers, attaching the Portuguese ruling, claiming the recipient of the notification to be in breach of a court order and finally threatening with lawsuits on behalf of the McCanns. All this has gne much too far, and if the Portuguese don't pull the plug on their corrupt and questionable at best so called judges and politicians it will not take long and the Portuguese democracy belongs to huistory.

  7. I can't read Portuguese, but get the gist of the report, namely that there is to be a demonstration on the 11th December in front of the Palace of Justice. I wish I was there to participate, but wish everyone taking part success and hope that justice prevails for Goncalo Amaral!

    Things are going very well for Dr.Amaral, I am afraid to disappoint you.Like it or not, he has an awful lot of suport and you will be able to witness it. He has an awful lot of support,especially from Spain.Remember? a few days ago,in the news it was reported a SPANISH editor is publishing is NEW book,launched on the 11-D.....somebody had to have the cojones to do it,hey? ;)
    WE are manifesting against DICTATURE against OUR rights being trod upon....including YOURS.
    WE are manifesting our disagreement with such bullying coming from fancy lawyers paid by a pair of less than HONORABLE people who are NOT able to look after THEIR kids properly,who have lied and continue to lie.

    The judge did not pretend that her ruling had jurisdiction outside of Portugal, she obviously would know better than that. The McCanns' lawyers, Isabel Duarte and Carter Ruck, are guilty of that offense, threatening bloggers and Gonçalo Amaral, etc.

    I do not know if the judge read the book or looked at the police files but as far as I know, she just listened to the witnesses of the McCanns and based her decision on that. At least she did not accede to all of their demands, such as prohibiting ANYONE from talking about the possibilty of Maddie's death. Also, the McCanns demanded that the books and DVDs be destroyed!! The judge ruled that they should be collected and stored away until the final decision is made. Knowing what their initial demands were just makes me despise this couple even more.

Thus, unable to free speech and economically stifled, we complete the siege of a man who has sought, at great personal cost and family solely for the reopening of proceedings, so that we can conclude an investigation that many feel they have fallen short of its potential.

    Dr Gonçalo Amaral can not talk. But we, Portuguese citizens, can speak for him.

    We can talk, and we can act.

    Acting in defense of freedom of expression, constitutional inalienable understand that, especially when it is he exercised in a responsible and mature.

    Acting in support who is deprived of means to defend themselves legally, as a result of deliberate moves by the person who seeks its destruction, personal and professional.

    Act today because the victim of the gag of censorship is Dr. Gonçalo Amaral - tomorrow may be any one of us ..

    And Amaral had a lot of consideration with Gerry, but A LOT!, not publicising everything Mrs. Gaspar told the police, lucky Gerry.

  20. If the McCanns manage to extract the money from Sr Amaral, then what is the cut of this for Isabel Duarte?

    What percentage can she expect to get her paws on? Would she have even taken the case if there were not so much money involved?

    As it has taken so long for the McCanns to come forward with this law suit it is obvious that the main reason they have waited is because of the money. Until that had gained in amount it was not worth them bothering.

    So much for the book hindering their search for Madeleine and the so called hurt feelings of theirs. If this was the case they would have taken action immediately. They certainly have had the money to do so.

  23. Joana, em princípio vou estar presente . A minha filha está melhor já combinei com a empregada para ficar com ela porque ainda não vai para o colégio. Só que não devo chegar ás 09:45 porque tenho de deixar os outros no colégio ás 08:30 e depois com o transito vou demorar uma hora ou mais a chegar.

Nunca me vou esquecer de quando li no Telegraph um artigo do Simon Heffer que tinha como título "Boycott Portugal", nunca me vou esquecer de ter lido repetidamente no Daily Mirror, pela mão do Tony Parsons, que nós Portugueses, éramos uns "mastigadores de sardinhas nojentos", nunca me vou esquecer das acusações feitas pelos média e por alguns políticos Britânicos quando disseram que Portugal era um país de fascistas e de pedófilos, quando transformaram uma tragédia que aconteceu a uma criança numa telenovela xenófoba que visava a descredibilização de toda uma cultura, um povo.

    Este ataque constante e visceral a Portugal e aos Portugueses continua, mas agora é feito pelo próprio sistema judicial Português que compactua com um casal Inglês que quer a todo custo silenciar toda e qualquer opinião que lhes seja desfavorável. Foi para isto que serviu o 25 de Abril?

    E eu também jamais me esquecerei da raiva que senti pela impotência de poder gritar em defesa do meu país e dos seus valores morais, contra essa onda de racismo exacerbado.

    Felizmente que Inglaterra não é os tablóides nem os jornalistas incultos e frustrados que vomitam torrentes de parvoíces com o único intúito de humilhar. Inglaterra é para além disso. E nós, como ”nobre povo” teremos de deixar os cães ladrar e continuar com a nossa luta pela verdade e pela decência. Vale-lhes sermos um país de brandos costumes. Os espanhóis ter-lhes-iam respondido olho por olho, dente por dente.

    Infelizmente concordo contigo. O sistema judicial do nosso país atravessa um momento de crise de confiança, e os exemplos recentes não nos deixam bons prognósticos para o futuro. Parece ter-se vendido aos poderes económico e político. Hoje, cada vez mais o 25 de Abril é um slogan apenas, quando deveria ser uma bandeira. Mas tenhamos esperança, talvez numa manhã de nevoeiro........

  38. Se Gerry esta em Lisboa, ja se percebeu o que foi la fazer tao cedo. Noticiam alguns jornais que a Ordem dos Advogados da Madeira arquivou a queixa de ilegalidades, no caso Leonor, apresentada por G. Amaral contra Aragao Correia. Mais uma vergonha a provar o envolvimento das altas esferas da justica em casos que deviam ser resolvidos pelos tribunais. Fogem dos tribunais como o diabo da cruz.
    Interessante como estas decisoes saem estrategicamente, sempre no momento que mais convem aos MCCANN. UM CONSELHO A SOCRATES: NA PROXIMA VEZ QUE FOR A ASSEMBLEIA DA REPUBLICA PARA MAIS UMA SESSAO PARLAMENTAR, LEVE O GERRY ja que e ele quem realmente governa Portugal.

    I am truly ashamed to be included as a British citizen. Those "press" reports are embarrassing, in this country it seems that we no longer have journalists, just lackeys, as GA so recently stated.

    Rest assured that the majority of the UK do not have these views, but keep that bitterness in your mouth as you face the McCanns on Friday (if they enter the front door, which I doubt). I truly wish I could afford to be there with you.

    We love you in the UK. We know that rosiepops (and the like) is(are) a McCann. We're not that stupid!!

    That sighting has got to be one of the best so far and yet it has been ignored by the McCanns. That speaks volumes.

    taking the profit to visit maddie's grave and to talk to Tapas 10, 11, 12?
    And go by car to Lisbon, brought by a friend?
    Just avoiding a direct flight to the capital?
    Tapas 10 will not recieve them, I think.
    11,12 probably will.
    Who knows, they are already in Algarve, direct flight from Madrid or France?

    . People without character which don't even know what they are supporting. People which had traffic fines in the pass and don't like GNR. Normaly they generalise and keep PJ and G. Amaral on the same bag. People which for some reason live behind illegalities, politicians and some famous writters which use the pages of the newspapers and their articles to work in a campaign of descridiblization of PJ and all the forces which fight for a judicial working system. They know, if the Mccann's MADE IT, and walk free, mean's that everybody with small power can do the same, specially if become friend of the top politicians and lawyers. It is like if because of your status, you are automatically above the rules. They have problems with criticising the Mccann's, even if they know or believe they are guilt, because they act at the same way, foolishing the system and the public to get some profits. They don't have problems to criticise the PJ, ignoring the amount of damage they do to the country. Anything to destroy the police image, it is good. That mean's some police got affraid of investigating some type of crimes and some people, and only step forward if at the back there is a powerfull and uncorrupt judge. OFF-course that it is the ideal system for powerfull people which find easy to live under dark situations. IT IS ALL ABOUT MONEY AND USE THE SHORT TIME WHEN THEY ACHIEVE POWERFULL POLITICAL JOBS TO BECOME RICHE, KNOWN AND GET SOME PROTAGONISM. After, all the doors become open and they end up as CEO of most of the public companys. A MAFIA. THE MAFIA SUPPORT THE MCCANN'S AND THEY DON'T SHOW ANY RESPECT TO MADDIE PAIN. What we know, were her last days in Portugal became just a fatidic acessory perfectly reliable to last plan. What is important is the image of the parents. THEY BELIEVE HE HAVE DONE A COMPETENT WORK AND ACHIEVE TO THE TRUE, but the parents suffer ennough by loosing the girl.

    UNFORTUNNATLY THIS IS NOT ANYMORE A CASE OF PAIN. IT IS A CASE OF JUSTICE AND ASHAME. PROBABLY if the Mccann's Shut-up after sept.2007, if they stop asking donations, if they don't feed an imoral campaign against Portugal and all the people with tan skin, if they just leave the justice work without showing the pressures trough the press and powerful lawyers, peraphs MOST OF US WILL GAVE UP LONG TIME AGO, NO MATTER IF JUSTICE WAS ACHIEVED OR NOT. BUT they choose the WRONG WAY... THE FIGHT AGAINST A NATION, AGAINST CARING PARENTS WHICH WORK HARD TO GET MONEY AT THE END OF THE MONTH AND AT SAME TIME GAVE ALL ATTENTION TO THEIR KIDS AND RAISE THEM WITH RESPONSABILITY. THERE IS NO FORGIVENESS FOR THAT MCCANN'S AND WHAT THEY HAVE DONE BEHIND THEIR CHILD TRAGEDY. WHO SUPPORT THEM IS SO CRIMINOUS... that deserve no RESPECT FROM ALL THE SOCIETY.

  45. I hope the witnesses like Tavares de Almeida not get affraid by the Mccann's and be imune to the pressures ant Madeleine's FUND money.
    I hope they tell the true in court and help Amaral to achieve justice. The country was fed-up of clowns and circus which don't amaze the public and add nothing to credibilise the justice.

  46. A message of support from England. I wish I could be there. Like ShuBob, I hope it will be peaceful, but I have faith in the supporters of this campaign. If people don't stand up to the rich and powerful, justice and free speech are in jeopardy in Europe.
    I would like to visit Portugal in the future, but whilst the MCanns and their entourage behave as they do, I would be too ashamed to admit to being British. I hope the Portuguese people don't believe we are all like this.

    I've thought about buying a plane ticket, but I think saving my money in order to donate to the fund for Amaral is probably better.
    Please keep it non violent. The press will need very little for them to portray the protesters as 'cruel thugs'.

  54. carol 51, Did you note that Hewlett has spoken to police but refused to speak to the McCann detectives because they are too pushy.Seems to me he was the ideal person to pin the blame on. He said he had did not kill Madeleine and I see no reason why he would change that story now. I truly believe if he had anything to do with it he would have confessed. This is just another way of putting doubt into people's minds and a way to try to strenghten the McCanns case against Amaral. Of all the pictures they could have chosen of Madeleine why that one taken when she was much younger. It is all so predictable and pathetic

You've got to laugh though. I am sure in the past there have been many people interviewed by the police who cannot speak for many different reasons but you know what - they have hands and can write what they want to say. If I was Mr Hewlitt I know what I would write in answer to them, unfortunately it's not printable.

  59. The McCanns will be scared of what comes out in court proceedings, scared of the publicity. Witnesses may describe the evidence and suspicions against them the police have found. They may highlight the published PJ evidence files. Hopefully the court proceedings will be open and publicised well, making it plain to the world the evidence against them and the police conclusions. Look out for the McCanns playing victim, trying to spin all this with all sorts of distracting stories in the UK press. If the banning of the book succeeds it has already inspired another book by Dr Amaral, and a book by someone else and so it goes on and on. They have turned public opinion against them in this campaign of silencing opinion. They have to go on but know they can't win.

  64. As far as possible violence, I think it would be a good idea to check the CCTV's in the area are working.
    There are bound to be agent provocteurs in the crowd and should there be violence it will be blamed on the pitchfork carriers - us.
    I had a disturbing thought - if the McCanns are being protected by those high up (which they are), the situation could becoming untenable.
    It might be best for everyone at this point if they were to be eliminated.
    Don't know where this premonition came from but it won't leave me alon.

  66. Anon @ 59: You may expect that PJ released about 15 to 20 percent of their knowledge with the DVD. They have still plenty of aces in the sleeve, i, e, evidence, but cannot make use of it because the case has to be re-opened first. And that is exactly what the McCanns intend to prevent by all means! They would love to have the whole police investigation banned and declared defamatory by another injunction. Unfortunately for them and good for us, this will not work! The McCanns are criminals. Many, many suspects went to prison for much less evidence. But, finally, even the McCanns will not escape justice. Their time is amost up.

    Yup, if Hewlett has any sense oh humour, he would say he'd killed MBM, put the body inside a container of fresh concrete, and dumped it in the sea miles away from the coast.

    Case solved, abduction proved, McScams right all the time!

    The fund would then be closed, monies given to charities (as the McScams have said they would), the ghastly couple bankrupt with a large mortgage and worthless stocks of T-shirts and wristbands.
