Artigo 37º
Liberdade de expressão e informação

1. Todos têm o direito de exprimir e divulgar livremente o seu pensamento pela palavra, pela imagem ou por qualquer outro meio, bem como o direito de informar, de se informar e de ser informados, sem impedimentos nem discriminações.

2. O exercício destes direitos não pode ser impedido ou limitado por qualquer tipo ou forma de censura.

3. As infracções cometidas no exercício destes direitos ficam submetidas aos princípios gerais de direito criminal ou do ilícito de mera ordenação social, sendo a sua apreciação respectivamente da competência dos tribunais judiciais ou de entidade administrativa independente, nos termos da lei.

O exercício desta liberdades, porquanto implica deveres e responsabilidades, pode ser submetido a certas formalidades, condições, restrições ou sanções, previstas pela lei, que constituam providências necessárias, numa sociedade democrática, para a segurança nacional, a integridade territorial ou a segurança pública, a defesa da ordem e a prevenção do crime, a protecção da saúde ou da moral, a protecção da honra ou dos direitos de outrem, para impedir a divulgação de informações confidenciais, ou para garantir a autoridade e a imparcialidade do poder judicial.

  5. There is a video of Andres Stagnaro singing Grandola Vila Morena, NMETV with the words subtitled. I don't speak Portuguese, but with a little Spanish and a dictionary, I'll try to work it out.

    Best of luck to Dr. Amaral. Actually, he does not need luck. He only needs Justice - the problem is, as Joana aptly highlighted, there is none, or if there is some, it is questionable.

    I wonder how the McCanns would react to such a shock.
    because this can become a long story, for years ans years, without an answer.
    again and again the same complaints, again and again the same defense.
    Long ago Moita Flores commented that there were enough elements in the files to start a process against the McCanns, starting with neglect and much more.
    By now Amaral seems to know a lot more than he knew when he published the book.

  19. The 25th of April, I was in Les Diablerets, in Switzerland, with friends on a skying program. I remember it as if it were yesterday. We were in a 2 chevaux, the snow was falling, my friend left the car to buy "Le Monde" and he came back screaming !

    I bet they know the sentence already.
    No information through twitter, by that Italian/British journalist(di Paolo?).
    I could not find the one from January. The text written on January is abducted, leaving no traces.

    I have a feeling Clarence has put the silencers on some of the media for this trip because after the January hearing the McCanns ended up much more unpopular than they thought possible. So he has obviously told them to use a bit more restraint this time. That can be the only reason why we've seen no pictures of them posing in front of the cameras yet. I have no doubt though that Martin Brunt and Sky News will be reporting from outside the Court.

  25. Uma breve viagem matinal pelas edicoes on-line dos jornais portugueses, mostra que poucos ou nenhuns dao importancia ao regresso do casalinho de terroristas a Lisboa. UM MUITO OBRIGADO AOS JORNAIS QUE RETIRARAM ESTES FARSANTES DAS PRIMEIRAS PAGINAS E LHES DEVOLVERAM A INSIGNIFICANCIA QUE TEM E MERECEM.
    Agora esperemos que a juiza se descole da vergonha que tem assolado os altos responsaveis da justica e devolva a voz a G. Amaral e a Liberdade de escolha ao mundo inteiro -ler ou nao ler o livro, compra-lo ou nao, deve ser um direito de escolha individual e nao uma imposicao baseada num crime de negligencia infantil grave e consentida. AFINAL SEMPRE HA MORDACAS EM PORTUGAL, ja nao so policias e magistrados a queixarem-se, sao tambem muitos jornalistas.

  26. 8-} Primeiro os "Mecanos" se recusam a colaborar com a Justiça Portuguesa e agora (surrepticiamente) querem fazer uso da mesma. Engraçado.

    Afirmam que o despacho do processo os iliba de qualquer culpa no desaparecimento da filha mas não e bem isso que diz. O que diz e isto:

    “the main damage was caused to the McCann arguidos, who lost the possibility to prove what they have protested since they were made arguidos: their innocence regarding the fateful event. The investigation was also disturbed, because these facts remain to be clarified.” (quote/unquote/translation by "The Blacksmith Bureau").

    Esta escrito no sumario do arquivamento do caso...

  27. JUDGE GABRIELA, WE WANT A SINGLE EVIDENCE WHICH SUPORT THE ABDUCTION THEORY SPREADED BY MCCANN'S. You must ask them where are the evidences of an abduction: More then 2 years of a private investigation with different detectives, and all presented as TOP ONES, must provided some evidences of the abduction. WHERE ARE THEY?

    We know, the witnesses heard by the court last month, showed the world that the official investigation find some evidences which lead the inspectors and the prosecutor to believe that there is a big possibility that Madeleine is dead and died in the flat shared by her parents. No evidences of strange persons at the crime scene. Experienced Criminologists also inform the court that an abduction under the circumstances described by the Mccann's was impossible. Criminology is a science, then we can say 2+2 always = 4. Then, no evidences of abduction + evidences of dead = THE FUND IS A FRAUD, GAGGING AMARAL IS A FRAUD, ASKING 1.2 M EUROS IS AN OBSCENITY, FORBBIDING THE BOOK IS ERASING ALL THE VALUES ACHIEVED BY A DEMOCRACY.
    More then Amaral or the Mccann's, who is at trial today is the Portuguese Judicial System. LETS SEE IF JUSTICE IT IS A CITIZEN RIGHT OR A GUN TO BE USED AGAINST WHO DID NOT FOLLOW THE PRIVATE AGENDA OF PEOPLE CONNECTED WITH POWER.
    I'm afraid that Amaral is going to be used as a scapegoat by the People involved with polemical cases in Justice in Portugal, to punish who violate the Judicial Secrecy, even if on Amaral case there is no violation at all. There is so many smoke screen behind "face Oculta" case and the Minister of Justice just gave importance to the judicial Secrecy and the violation of it. A shame...
    I just heard now Sandra Felgueiras in RTP saying that the Mccann's are indignate because the portuguese police received several witnesses of sights of Madeleine in Portugal and Italy ( A new Country in the saga) with pictures and never call them to identify the people. Another joke, coming from this two. They really believe that people and police buy there stories? Every sight is checked between PJ and the official polices where the sights happen. Most of the sights the polices ( PJ and others) already assumed were false and have no grounds to be checked. I know, the Mccann's love to travel to Portugal, to stay at 5 star hotels special if this happen under somebody expenses, but the Country have more criminal issues so serious to spend the money of Portuguese citizens. PORTUGUESE TAXESE NOT TOFEED FAIRY TALES, EVEN BECAUSE THE MCCANN'S FAIL TO HELP THE INVESTIGATION WHEN THEY REFUSED TO DO THE RECONSTRUCTION. AS THE JUDGE JORGE PALMA SAID TODAY, maybe Portugal must have a menu to serve justice according to the status of the people. SINCE WHEN THE WORDS OF GERRY AND KATE SHOULD BE ACCEPTED AS FACTS, SERIOUS AND RELIGIOUSLY FOLLOWED? Give as brake... FORTUNATLY WE HAVE BRAINS!!!

Uma vergonha, a demonstrar que nem a advogada portuguesa eles respeitam. Estou a imaginar, se o caso fosse em Inglaterra... esta-se mesmo a ver que os VIP Carter-RUCK lhes davam tal tratamento. A Rainha que se cuide-NAo tarda nada estes dois proclamam-se... O QUE OS EUROS E AS LIBRAS DO FUNDO PAGAM. Cartazes nos carrinhos dos supermercados espanhois e Algarvios, e que nao. Ja ESTAO ESQUECIDOS, NAO DAO CREDITOS NEM OS PROMOVEM AO ALTAR DAS ESTRELAS!!

E bom que a Juiza Gabriela e os responsaveis pela Justica Portuguesa saibam como sao noticiados os assuntos relacionados com Maddie e Portugal, pelo mundo fora e em sitios extraordinariamente distantes de Portugal. Hoje nos noticiarios da manha da "Radio one" do Dubai, a locutora apresentava mais ou menos assim a noticia: "PAIS DE MADELEINE MCCANN " VANNISHED IN PORTUGAL" presentes no tribunal em Portugal, para assistirem ao julgamento da policia portuguesa envolvida na investigacao ao seu desaparecimento."

    Lamentavel. E assim que se espalha uma mentira e se queima a imagem de um pais. Nao acredito que algum jornalista desta radio ( a mais importante do pais) se tenha deslocado a portugal para fazer a cobertura do caso, nem acredito que a noticia lhes tenha chegado a redaccao via Lusa ou alguma entidade oficial portuguesa, muito menos partindo de G. Amaral. Portanto para bom entendedor sobram poucas hipoteses: A noticia so pode ter chegado a redaccao da radio via Mccann's e seu Porta-voz, convenientemente redigida para dar a entender ao mundo que eles conseguiram levar a tribunal e julgar a policia portuguesa. Uma mentira!!! O que esta em julgamento e o direito a livre expressao e o proibir ou nao um livro, nao a investigacao portuguesa. QUANTAS RADIOS, JORNAIS, TVS, PELO MUNDO FORA RECEBERAM ESTA NOTICIA CONVENIENTEMENTE MANIPULADA E A DIVULGARAM? Entao quem e que devia estar a ser julgado? Ate quando a justica e as autoridades portuguesas vao permitir este tipo de estrategias? Felizmente ha sempre um portugues em qualquer canto do mundo para se indignar e protestar, foi o que fiz. Mas as nossas vozes isoladas tem pouca chance de serem ouvidas e em Portugal reina o marasmo que esta a afundar o pais. ATE ONDE VAI A OUSADIA DOS MCCANN QUE INSULTAM PORTUGAL DE CADA VEZ QUE SE MOSTRAM PUBLICAMENTE?
    GONCALO AMARAL, os portugueses pelo mundo fora estao consigo. Li o livro e nao encontrei nenhum insulto, nenhuma difamacao, nenhuma violacao do segredo de justica. Tudo o que esta no livro ja era do dominio publico do mundo inteiro e a maior parte via Mccann's ou o seu Porta-voz que estrategicamente largavam ou plantavam noticias nos jornais ingleses para poderem contesta-las e por em causa a investigaca, ou apelar a donativos. PORTUGAL ESTA MERGULHADO NA MAIOR VERGONHA DE QUE HA MEMORIA.

  35. Now the McCann's are asking for a review of the case....at last, we are all in agreement, time to re-open the investigation - maybe with a proper reconstruction and maybe Kate will answer the questions?

    Maybe the judge will find against Dr Amaral but on the basis that the investigation is re-opened?

    - 'vigilant' parents sitting at the restaurant with their backs to the apartment where their "three children" were sleeping, alone. If you're vigilant, you FACE impending danger, not turn your back to it...well, unless if you've got eyes at the back of your head.

    - frequency of monitoring stepped up that night. A conscious decision must have been taken to do so, the question is WHY?

    - Kate made it her point of duty to go into that bizarre story about Madeleine asking why she hadn't come when they were crying. Bad timing and strange coincidence that Madeleine should have disappeared that night, or stage-setting? And although bothered by that event enough to mention it, she proceeds to be the 'vigilant' parent sitting with her back turned to the apartment.

    i agree when you say it happened before dinner. someone needs to go back and look closely at what happened, when, and with whom before that 8:30/9:00pm dinner on the 3rd of May 2007.

  37. I watched Skynews today, twitter, Lisbon, I found lawyer Cabrita spoke extremely well, convincing and well prepared.
    I believe Isabel Duarte would have done well if this process was not so extremely difficult for her to convince the court the McCanns are innocent victims, which they are not.

    I believe this is the most tough case she has been confronted with in her life, a negative propaganda for her.
    I believe she is a good lawyer but even a good lawyer can not cover up the truth.
    Lawyer Cabrita's arguments were to the point and Isabel Duarte had very little left to defend the McCanns.
    About new sightings across Europe, after the process was shelved, I really felt sorry for her.
    I'm glad she did not tell in court that Madeleine was again seen at gas stations, still wearing the same pajamas.

    I bet she got very old during the last weeks.

A bit too close for comfort, this Lair in Praia da Luz, especially with Mama and Papa McConn [sic...] within sniffing distance and still not having the gumption to go get her. Hey, cast that net a bit wider wouldya?! Spain.... Italy.... The Moons of Saturn........
