Supreme Court turns down McCanns' request

Kate and Gerry McCann wanted the Supreme Court of Justice to nullify a decision by the Appeals Court that allowed for the book by Gonçalo Amaral, ‘The Truth of the Lie’, to be distributed. Nonetheless, the judges have refused the request.

Former Polícia Judiciária inspector Gonçalo Amaral will again be able to sell the book about the disappearance of Madeleine McCann, ‘The Truth of the Lie’, which was taken off shelves after an injunction that was filed by the parents of the little English girl that disappeared in Praia da Luz was accepted by a lower court.

The Supreme Court judges refused the request for an “exceptional review” of the Appeals Court’s decision, which overturned the injunction that had been filed by Kate and Gerry McCann.

The counsellors’ decision may be appealed to the Constitutional Court, but that will have no suspensive effect, which means that Kate and Gerry McCann will have to return every copy of Amaral’s book that they possess.

If they do not comply, they may even incur in a crime of disobedience.

Contacted by Sol, the McCanns’ lawyer, Isabel Duarte, refused to comment on this judicial decision, because she hadn’t been notified yet.

It was issued on the 9th of September, 2009. (...) It should also be recalled that this injunction was granted exclusively based on the evidence that was provided by the Applicants. The Defendants were only allowed to oppose the injunction after it had been granted.

    Sorry McCanns but your evil deeds over the past 4 years are coming back to bite you on the bum and I can't say how pleased I am about that.

    Let's hope Goncalo can get this book out in English as soon as possible to show how manipulative the McCanns have been with their one sided "abduction" story.

  7. This is very good news. I wonder if they still have the copies of Amaral's books or if they already destroyed them. If destroyed and unable to be returned to Amaral, will the McCanns be legally required to pay for the cost of the books? Wouldn't that be ironic?

    Here's to the English version of Amaral's book being officially published in the very near future.

  10. Gonçalo Amaral has refused to be forbidden from telling the TRUTH about the investigation into Madeleine's disappearance. His commitment to justice is unwavering and at great personal cost. It has been a long road, and it is not "over" yet... but he has never wandered from the facts of the case and he has shown his professionalism and courage in a way that should be an inspiration for anyone who cares about the rule of law.

  12. This is indeed good news for Mr. Amaral and his family. I pray he will now be able to provide the truth in English for the entire world to learn of his investigation and his struggle to tell the truth to others. I have read about Kate McCann's book, which is to be unveiled shortly, and that she will finally tell "the truth" about Madeleine's disappearance. Surely the mother and father of a "missing" child should have told "the truth" at the time she went "missing". God bless Madeleine and all those who have worked tirelessly to get to the REAL truth of what happened to her.

    The MCs really need their first book to be a success otherwise they will have to sell the house to foot the bill - quite an irony of fate when you consider this was exactly what the MCs hoped GA had to do ...

    It's a tough choice: the self-exculpatory ramblings of one of the former arguidos, or the factual account of the investigation as told by the former PJ inspector in charge of the case.

  18. Very good news. Amaral's book 'The Truth of the Lie' should never have been banned as it's simply a documented record of the police investigation. The problem for the McCanns was never about libel, it was, and still is, that Amaral's book and documentary clearly demonstrates that - using the Tapas 9 own accounts of what happened - an abduction was just not possible.
    I think the McCann's have known for a long time that they would lose and the decision to write their own book is not only about collecting more money but also a pre-emptive strike in the event Amaral now finds an English publisher. An English version would have a big impact - and not just in the UK. They know Amaral might find it easier to find a US publisher and, imo, apart from the money angle, that is another reason they have targeted the US market, ie: 'Maddie in US', planned interviews etc.

  20. Whoopee,does this mean that Goncalo will be allowed to sell his book in the UK? I hope he can, because he speaks the truth in his book.Unlike the book Kate McCann has written which will be based on the lies she and her husband have told for the past 4yrs. She can't write anything else, because if she told the truth, she could find herself facing the justice she should have faced 4yrs ago.

    Kate McCann has her own page on Amazon and along with her husband she is being slaughtered, by most of the people who are discussing her book. I don't believe her book will be a best seller, I believe Goncalo's book will be.

    The McCanns have been taught a valuable lesson, that they are not above the law.

Brilliant news!!!! wont be reading about it from our cowardly s**t scared press as they have a job to do protect the child neglectors(in the very least)so i want to say CONGRATULATIONS to Mr Amaral and his family a lot of us in the UK are behind you and have been waiting to read this news, i just hope things get even better and the "real truth" does come out one day and justice for the innocent 3 year old is served to the vile culprits.

  27. This is the second court case the McCanns have lost in 5 months. The first court case they lost was when Goncalo appealed against the ban on his book.

    Costs were awarded against the McCanns in that court case and costs from the Supreme Court, which are likely to more than the appeal court, will no doubt be awarded against the McCanns.

    Does anyone know if the fund is likely to be paying these costs? If that is so, it is no wonder the fund is in dire straits.

  30. Those who seek to to hide their secrets behind their reputations will spare no expense to silence the critics and the McCanns are living proof that "reputation" is ALL that matters to them. A long, pointless & vindictive campaign has been waged against Gonçalo Amaral that served absolutely no purpose whatsoever in the genuine search for a missing child. Gonçalo Amaral's book never threatened the quest to "find Madeleine". It was the McCanns wasted years of "legal wrangling" against Amaral and many other critics that always threatened the quest to "find Madeleine" in my opinion.

  34. I hope the media in the UK will have the courage and the chance to publicise about this above.The decision of the judges in Portugal will give a lot of strengh to the British media.
    They want to write the truth but they are gagged by British laws.
    They got to find a way to inform the public about this, without paying millions to the McCanns.
    It's nearly April and I expect more surprises from Wikileaks and not to forget the 2 new charpters Amaral wrote.

  36. The photo shows the wind of change buffeting the McCannsas the doors to more and more legal costs for them are blown open. What a fine man Goncalo Amaral is and his family too. These two monsters will get their just deserts. They have shown their ill will against the legitimate police investigation into their child's disappearence. The reasons are obvious. Snr Amaral's book should be printed in English for distribution in Europe from where it can easily find it's way into the UK without being published there. I hope Snr Amaral hears that books can be distributed by donating to charities in the UK for resale, and donated to libraries. Problem solved.

  37. Still no news about this story in the British media. I half expected Martin Brunt to report on this story, on the Sky News Website. He was very informative when the McCanns first court case against Goncalo Amaral, began in January 2010. He also commented when they managed to get Dr Amaral's book banned.

    I don't remember him commenting when Goncalo Amaral, managed to get the ban overturned and so far he hasn't made any comment on the latest developments.

    He is either a staunch supporter of the McCanns or he has been gagged by his bosses.

  44. I wonder if the McCanns will use the fund money, to buy a few copies of their book, in order to boost up the sales. Always assuming there is any money left in the fund. They've had to shell out rather a lot of money in their failed attempts to remove Dr Amaral's book, permanently from the shelves.

    Good luck to Dr Amaral, I hope both of his books are best sellers and they provide the missing piece of the jigsaw that will bring the McCanns to justice for their part in Madeleine's disappearance.

    I would love to see one of Dr Amaral's books serialised in a British newspaper. Preferably the Daily Express.

    Anybody who genuinely believed that their child had been abducted and was being held captive would welcome any dissemation of information that may lead to her recovery. It is beyond the bounds of incredulity that parents of that child would use any means at their disposal to prevent any spreading of information that may lead to the recovery of the child.
