Gonçalo Amaral sobre os erros cometidos pelos jornalistas quando dizem que o julgamento é por difamação.

Lendo as notícias acerca da última sessão do julgamento fico com a certeza que a grande maioria dos jornalistas desconhece o que ali se está a discutir, e não se informaram de forma correta.

Sejamos claros. O que está em causa é saber:

- Se a escrita do meu livro “Maddie: A verdade da Mentira” constituiu um acto lícito ou ilícito;
- Se os autores sofreram danos e se existem factos que os provem;
- Se é possível estabelecer um nexo de causalidade entre o livro e tais danos.

È isto que está em causa.

Quanto à licitude do livro, sugiro a quem tenha dúvidas que leia o acórdão do Tribunal da Relação de Lisboa no âmbito da providência cautelar que precedeu a acção em causa. Na verdade, para os Ex.mos Senhores Desembargadores, como se pode concluir dessa decisão, a licitude da publicação do livro é incontestável.

Quero com isto dizer que, com esta comprovada licitude, o assunto deverá ficar por aqui, sem necessidade de se averiguar mais nada, nomeadamente no que respeita aos danos de que os autores se queixam. Mas, note-se, mesmo que tal licitude ainda possa estar em causa, haverá, ainda, que estabelecer um nexo de causalidade entre a publicação e os danos de que os autores se queixam, tais como depressões profundas, isolamento social, etc…E, claro está, provar que tais danos, seja qual for a sua origem, existem de facto.

Quanto à parte social, parece-me óbvio, se atentarmos aos inúmeros eventos sociais em que os autores têm participado, incluindo, pasme-se, discursos no próprio Parlamento Britânico, entrevistas em programas como o Oprah Winfrey, jantares de gala como as mais ilustres personalidades, nomeadamente britânicas, entre muitos outros, o dito afastamento social é totalmente falso.

Já quanto às depressões, embora, de forma alguma se encontrem provadas no processo, a meu ver, a verdade é que muito estranho seria se não existissem. O desaparecimento de uma filha, esteja morta ou viva, tenha sido ou não raptada, não pode deixar de originar enormes sequelas desse tipo. Muito estranho seria se tal não acontecesse! Mas a este respeito já não digo nada, na medida em que os autores parecem querer imputar-me a mim e ao meu livro todas as suas dores, como se o referido desaparecimento, acrescido da sua constituição como arguidos e demais circunstâncias que rodeiam o caso, só por si, não tivesse qualquer importância, ou não fossem mais do que suficientes!

Infelizmente, devido a manobras claramente dilatórias da parte dos autores, que obrigaram, mais uma vez, ao adiamento da audiência, receio que o processo se arraste – como eles claramente pretendem -, e não tenhamos sentença proximamente, como eu gostaria e pela qual anseio. Ainda para mais quando se iniciaram já as férias judiciais e, como a Ex.ma Sr.a Juiz bem explicou, com a entrada em vigor do novo mapa judiciário, em 1 de Setembro, a morosidade processual irá agravar-se consideravelmente. Da minha parte, porém, mantém-se inabalável a confiança na justiça portuguesa.

Resta-me agradecer e reconhecer todo o apoio que tenho recebido, por parte de todos aqueles que acreditam na justiça e na verdade, sem o qual não me teria sido possível fazer face ao processo. Nem tampouco, levar-me a ponderar, como estou, intentar um processo contra o casal McCann e outros, com vista a ser ressarcido dos enormes prejuízos que já me causaram a todos os níveis, tais como morais, profissionais e financeiros.

Vai sendo tempo de reagir judicialmente contra todos aqueles que têm colocado em causa a minha, privacidade, intimidade, liberdade de expressão, opinião e condições de subsistência.

Tentaram assassinar-me civilmente, mas, graças ao apoio e solidariedade de todos vós, não conseguiram.

Gonçalo Amaral on the mistakes made by journalists when they state this is a libel trial, it isn't.

Upon reading the news about the last trial session I became certain that the vast majority of journalists is unaware about what is being discussed there and they have not informed themselves properly.

Let us be clear. What is at issue is to establish whether:

- If the writing of my book “Maddie: A Verdade da Mentira” [Maddie: The Truth of the Lie] has constituted a licit or illicit act;
- If the authors of the claim have suffered damages and whether there are facts that prove them;
- If it is possible to establish a causality nexus between the book and the alleged damages.

This is what is in question.

As to the legitimacy to write the book, I suggest to anyone who has doubts to read the Lisbon Appeals Court ruling within the scope of the temporary injunction that has preceded the legal action at stake. In fact, for the honourable Appellate Judges - as one can conclude by their decision - the lawfulness of the publication of the book is indisputable.

By this I mean that, since the legitimacy was proven, the matter should come to an end, without ascertaining anything else, namely what concerns the damages alleged by the authors of the lawsuit. Yet, it should be stressed that even if that legitimacy remains in question, it will still be necessary to establish a causality nexus between the book and the alleged damages claimed by the authors of the lawsuit, such has the deep depression, social isolation, etc. And, of course, to prove that those damages, whatever their origin may be, factually exist.

As to the social aspect, it seems obvious, if we take in consideration the numerous events the authors have attended, including astonishingly, speeches at the UK Parliament, interview in talk shows such as the Oprah Winfrey's, gala dinners with distinguished personalities, mainly British ones among plenty others, then the so called social isolation claim is utterly false.

Regarding the depressions, even tough they were not proven in any way in the legal proceedings, in my view it would be very strange if they didn't exist. The disappearance of a daughter, whether dead or alive, whether abducted or not, cannot but originate enormous sequelae of that sort. It would be very strange indeed if that did not happen! But regarding this issue I won't make further comments since the authors appear to want to apportion blame on myself and on my book of all their suffering, as if the aforesaid disappearance, in addition to their subsequent constitution as arguidos [formal suspects] and all other circumstances that surround the case, don't bare any importance, or as if they aren't already more than enough!

Unfortunately, due to the clearly stalling tactics on the part of the authors, who forced, once again, the postponement of the hearings, I fear that this process will drag on - as they patently intend - and that we will not have a ruling in the near future, as I would like and for which I so longed for. Even more so since the judicial holidays have already started, which along with the reorganisation of the judicial chart on the 1st of September, and as explained by the Honourable Judge, will worsen the lengthening procedures considerably. On my part, nonetheless, my confidence in the Portuguese justice remains unwavering.

All that remains for me now is to express my thanks and acknowledge all the support I have received from all those who believe in justice and truth, without which it would not have been possible for me to cope with the process. Or without which I could not even consider, as I am, to bring a lawsuit against the McCann couple and others, in order to be reimbursed of the extensive losses that they have caused me at every level, namely morally, professionally and financially.

Now it is the time to react judicially against all those who have jeopardized my rights to privacy, intimacy, freedom of expression, opinion and livelihood opportunities.

They have tried to ‘assassinate’ me judicially, but thanks to the support and solidarity of all of you, they have failed.

English translation and review of the Lisbon Appeals court ruling done by several people, including Caroline, Pia, "Ines", Sofia [astro] and Joana Morais.

«[...]We thus reach a point where it seems to be important to stress the following: the indicative facts that led to the applicants’ constitution as arguidos within the inquiry were later on not valued by the Public Ministry’s Magistrates in order to lead to a criminal accusation, but those very same facts, seen through another prism and with another base, may lead to a different conclusion from that which was attained by those same Magistrates – those are indications that were deemed to be insufficient in terms of evidence in a criminal investigation, but they can be appreciated in a different way, in an interpretation that is legitimate to be published as a literary work, as long as said interpretation does not offend any fundamental rights of anyone involved – and we have written above already why we understand that said interpretation does not offend the applicants’ rights.

Please use this time to state openly what you know and to expose the inconsistencies. In the UK the exposure of the establishment role in covering up sexual crimes is starting to unravel and if this happened in this case too the truth will come out at some point. You are an intelligent person who knows how the world and PR people work so dig deep and follow it through for the sake and safety of all younfg children who are neglected by their parents.     A isto eu acrescentaria o facto de o casal ter continuado a ter o "apoio" dos seus vizinhos e da comunidade em Rothley, com vigílias, missas, etc., aparentemente não foi ostracizado e alvo de declarações públicas de condenação.É claro, que isto pode ser só aparência e resultado do longo braço legal dos Carter-Ruck...mas lá que os McCann não podem alegar consequências sociais nefastas no seu circulo mais próximo, lá isso não podem...bem pelo contrário, nos media só houve relatos de "grande apoio" da comunidade "rothleiana"!

  3. Few points on questions asked elsewhere

    The correct expression for the McCanns lawsuit is "acção de indemnização" that would translate to a "lawsuit for damages and compensation". The trial should be just called simply that or a 'trial for damages' if people feel the need to adjectivate it. The 2009-2012 was a "processo conexo" to this main lawsuit, that is, it was a connected process. The correct name for that connected process it a 'temporary injunction' [providência cautelar], that forbade the book written by Gonçalo Amaral, published by Guerra e Paz and the documentary produced by VC films, broadcast by TVI to be commercialized, injunction which was overturned by the Tribunal da Relação de Lisboa [Lisbon Appeals court] in Oct. 2010. However, with more dilatory legal manoeuvrings, the McCanns were able to delay the return of the book copies to its rightful owners [Guerra e Paz book publishers] until April 2012 when their last appeal to the STJ - Supreme Court of Justice failed. Both book and documentary copies and rights can be sold, distributed, broadcast since the 2010 ruling.

  5. I don't have much faith in the Met police but I keep on hoping that I'm wrong and these two fraudsters are exposed for what they are. I don't know how this travesty has continued for so long but one way or another I believe karma will get them, but I'd rather it was the law.

    I am not from the UK or Portugal.
    This case is creepy.
    I do feel pitty for the Uk to keep on with this case.
    It just make them look stupid.
    I cannot understand why it never stopped, but grow so much.

    Dr. Gonçalo Amaral writes extremely well. He is certainly not a "cretin" like Tony Parsons or Andy Redwood, say.

    Those of us - you in particular - who have fought for years to upheld the Freedom of Opinion in Portugal and Dr. Gonçalo Amaral basic rights as an expert writer, can only hope the "million dollar" judge is reading... assuming she is not under orders from The Executive - very much like Scotland Yard is...

    The whole truth about the Westminster child abuse scandal will never come out imo - just a few individuals who are either dead, or no longer of any use, will be exposed to placate the public.
    The child abuse scandal involves the abuse thousands of vulnerable kids in the care system. Nobody in authority cared what those kids endured and though many of them did go to the police, nothing was done. The Met police has covered-up more times than they've had hot dinners, so when DCI Redwood says everything he does is for Madeleine, it's difficult to take him at his word. Why would the Met care what happened to one child in Portugal when their track record shows many children who suffered the worst type of abuse were of no consequence to the police - but the reputations of influential people were clearly of the greatest importance to them? Maybe things have changed and I hope I'm completely wrong on this, but imo the McCann case has always been about protecting the reputation of the tapas 9, not what happened to the little girl. Though I'm not convinced the McCanns are the most important members of the group - Oldfield possibly?

    Our civil liberties are being gradually eroded by a snooping state on the pretext that it is necessary to stop terrorism, organised crime and paedophilia. Given that, for decades, the security services have been involved in covering-up child abuse and protecting violent child rapists like Cyril Smith and others, child welfare is obviously the least of their priorities so it's more likely paedophiles were simply added to the list as a sop to the public - the establishment knew that people would be far less likely to protest if they thought the stringent surveillance measures ensured a higher level of protection for children.
    Most of the information re parliamentary child abuse cover-ups has been on the internet for decades but has only recently been picked up by the MSM and I wonder why now? I wish it was a sign that corruption was being tackled but perhaps it's really about some kind of on-going power struggle that we don't yet understand.

  10. @3. Since the injunctions were over turned, it has to be clear to the judge that these rulings should be used to make a decision, in favour of logic and common sense. ie Mr Amaral. The macs are happy now to delay the proceedings forever, so that Mr. Amaral cannot get his money, thus keeping proceedings in limbo.

The only Compensation the mccanns deserve is a lengthy sentence for the pair of them in a Portuguese Jail , These two fraudsters have no shame at all , they would take a penny from a beggar , their greed will end them in Jail , and deadwood or the British Government will not be able to help them flee Justice . The Met Police are as "trustworthy" as a nest of vipers , its time the Portuguese People petitioned their Government to Boot the British Police out of Portugal and conduct the investigation themselves without let or hindrance from the British establishment , the British Police cant solve half the crimes in the UK how the hell can they claim to solve a crime in Portugal ? As for the idiot deadwood and the other cretin who had to "apologise" on live TV for the "shooting" in Brixton , one day they will both be held to task , in a court of law and the public should demand lengthy Jail sentences for the lot of them . They are a disgrace to the uniform , going around digging holes in foreign lands like a bunch of idiots when the real culprits are in the UK in rotley towers payed for by the fraud "fund"

  12. Can anyone please explain to me based on the above update from Goncalo Amaral ...

    Why has the Judge has requested the details of the Money made by the book?
    What has that got to do with anything if the book is legal - which it is!

    If the points listed in the update are the remit of the case - then what is going on ?

    It has been established the book is NOT Libellous !..... Case closed!

    Lastly... It has already in LAW been established that Madeleine can NOT be represented by the Parents due to the ward of court (WOC).

    As an aside It would be interesting to find out who has funded the case for the McCann's against Goncalo Amaral ?

    They legally can NOT represent Madeleine, so if the Madeleine fund has been used it has not been used for its dominant purpose.

    All that aside ....I can not understand how this case has been allowed to even proceed ..It does not in law meet the requirements to be a legitimate case.

    If justice works in silence.....It certainly commits many injustices loudly along the way.

    I hope Goncalo's faith is not misplaced - he deserves to be held in high esteem for his courage and conviction to do what was the right thing. In the peoples hearts and minds he has already triumphed now its down to the "system"

  13. Sometimes we can get too consumed with the case in hand that we forget the implications of the VERDICTS.

    It may be worth considering that should Justice be done, and Goncalo wins the case
    then the flipside for him ( I say flipside because in my opinion the case is not legal in its current form), will ultimately mean that the verdict from this case becomes the evidence he requires, to WIN any actions he chooses to take against the McCann's and "others" for what they have waged against him over an extremely long period.

    This is why the delays are taking place in my view ....all the implications of the judges decision are been checked out.

    My own opinion remains that the case will either drag on allowing for a different narrative via the investigation...Ultimately to allow the court to make a decision that the judge can use to null the case ......or that the judge will rule against Goncalo Amaral anyway because of what is at stake regarding the cover up.

    Either way I do not see Justice been done in this court ...that's my opinion.

    I hope I am wrong - lets see.

    One thing is for sure... speaking out for Madeleine was an off-side that only enriched the MC Fund!

    The judge was forced to do so by Madama Duarte. The gambit has at least two objectives. I think.

    (1) To (try) to prove Amaral profited from the "defamation" of the "Mau-Canos" (just his professional, expert opinion in fact)

    (2) To find out how much money he has or had or is hiding or how much her clients can profit from or perhaps to see if there is enough to cover her fees. She should not worry about the latter, thought. The Fund pays!

    The judge may not be interested in the money but she has to on the basis of Madame Duarte perfectly acceptable legal demands.

    If the money was hidden, the "Sticking Pipes" (Mau-Canos in Portuguese) may have a case. Not a defamation case, of course.

    The goal of the exercise, least we forgot the underlying reputation management, is to destroy Amaral credibility and of course make him destitute - which is unlikely given the massive world-wide support he has received.

    It's all about legal rhetoric and psychological games.

    How it will end no one knows for sure. The judge seems good but then she is high-up in the hierarchy which means she is working for The System - very much as Scotland Yard is. It does not bode well for Amaral... who might be heading for the Appeals Court.

Maybe Kate will "decide" to answer why she refused to answer the questions put to her by the Portuguese Police 7 years ago ?     I have to say, it all looks cart before the horse to me. Logically in my mind you would need to prove the defamation, before gaining legal access to the associated profits/bank details etc.

    Are we infact saying that.. anybody.. has the legal right through a lawyer, to demand an authors details regarding his/her profits and banking arrangements associated with their books.....without anything been proved in a court of law against them.

    So if you want to scare someone, let them think they will lose the case by asking for details of any earned income, before the judge makes a decision.
    Well, I suppose it is optimistic of the McCanns to be that sure they will win but of course Dr Amaral has more about him than to fall for any psychological games designed to undermine his steadfastness and credibility. It is going to be impossible to decide how much 'the book' affected the public and the search when so much material was already out there.

    I have never read Mr Amarals book in full. I don't need to, in order to support him. I support his right to freedom of expression, and freedom of speech. I don't know what happened to little Maddie, Mr Amaral had a different opinion to the parents as to what may have happened ( a theory). There is nothing wrong with that at all. The PJ and NSY have investigated a lot of 'innocent' people who the mccanns pointed their finger at- to take the attention away from them and the part they played in her disappearance. (neglect) They facilitated the fate of what did happen to Maddie.

    I mentioned in another forum, Team McCann are bemoaning about the 'harm' to them and their three children by the hand of Mr Amaral- his book and the affect it had on the search.
    1. they failed to provide evidence of the scale of harm to the twins, cause by a book.
    2. they failed to provide evidence of the book contents having a negative affect on the search for an 'alive' child. i.e who stopped looking? (apart from the parents).
    3. they failed to provide evidence of harm to Maddie as they claim to not know where she is or her mortal state (dead or alive).

    Therefore how can a judge possibly award money to someone without evidence of harm by the book ? ( now she might be a tad miffed at being left alone, abducted, raped, tortured)?, but apart from that, she would have been 'fine' until this book was published. Sadly she isn't here to tell us- Thanks to her parents.

    I did shudder when Kate said the documentary was worse... Hmm what will the twins think when they grow up and read all this.

I would suggest that search of apartment at about 10 by non-police, and search of apartment by a little after 11 by GNR, were rudimentary and incomplete,, and therefore it perhaps should not be ruled out that the actual physical disappearance from apartment may have been later than those two searches?

    Insight team Heidi Blake and Jonathan Calvert who wrote the article last October about the
    Efit pictures, over which the McCanns have allegedly recently filed a case in the High Court,
    lost a libel case against multi-millionaire Tory party co-treasurer Peter Cruddas over cash for
    access. However the Sunday Times has appealed the Cruddas case, and the judgment of
    Justice Tugendhat (who presided that case) has been questioned by the appeal court, so
    there will now be an appeal trial on that case, which was about cash for access
    (i.e. corruption). Judge Tugendhat also presided at the trial of Tony Bennett for
    contempt of court.

  51. The Express report again that Scotland Yard are offering £20,000 as a reward for information. They should give this to Mr Amaral and Mr Smith and his daughter, who both could offer information. Would you not think, Scotland Yard, that lie stories will come again, if they want the truth they should question the nine. Most people in the world believe that Madeleine died in the flat and the British people think Amaral speaks the truth. Why the mccanns always sit together, its time to get them in different rooms when questioned.

  53. Recently a British Police Force issued a European arrest warrant to detain the parents who were acting in the best interests of their child and removed him from the care of a British hospital. The parents were arrested and jailed in Spain and forced before a judge, to prove them selves innocent of any intent to harm their child.
    And yet the Portuguese police steadfastly by their inaction refuse to issue a European arrest warrant for the return of the two parents, who whilst in Portugal neglected and abandoned their children by leaving them alone in an apartment completely unprotected.
    As a result of that neglect one has disappeared and is probably dead the parents named McCann continue to disparage all things Portuguese and yet they are not forced to face trail in Portugal.

    Something stinks in Portugal me thinks.

  56. Just so I don't have to repeat the same: regarding the trial (published here first as an answer https://www.facebook.com/groups/JusticeForMadeleine/permalink/000000000000000/)

    There was never a date set, not as far as I know. The changes introduced by the new judiciary chart where courts were dissolved and agglomerated into larger ones resulted in chaos at the Citius site (main digital platform for distribution of court processes/cases and where the hearings/sessions are recorded into) where over 3,5 millions processes that should have migrated to the new courts "disappeared", are "lost" somewhere.     Reasons:

    Despite seven years of investigation, Madeleine’s disappearance remains a mystery. There are numerous concerns about the conduct of Leicestershire Police, Scotland Yard & government officials who became involved in the case.

    There are also major concerns about the investigation by Madeleine's Fund, a private company regulated by the Department of Business. The combined efforts of these organisations have yielded no answers about what really happened to her, nor who was responsible for her disappearance, nor where she might be.

    The Leicestershire Police and Scotland Yard investigations have cost around £10 million so far. Madeleine’s Fund also spent millions of pounds on private detectives, mostly coming from the generous British public.

    The Portuguese Police and police forces around the world have also spent millions on various investigations and following up claimed 'sightings' of Madeleine.

    We need an independent public enquiry with the power to summon relevant witnesses.

    Mr. Amaral would have to do so through a British court and the British (unlike their Portuguese counterparts) would laugh off such move. Me thinks.

    Likewise, any attempt to do so through a Portuguese court will not work as the McCanns' are unlikely to recognize the competence of a Portuguese court to judge them - wait and see...

    Like the old alliance between Portugal and England (the oldest in the world) it only works for the benefit of the British - it is not mutatis mutandis.

    British ideology and cultural hegemony still applies - a matter of historical conditioning, I suppose. Sad, I know.

    On the other hand, Britain is poised to leave the EU as well as The European Charter of Human Rights so any future appeal to the European Court in Strasbourg by any of the parties is probably a mute point too.

    Mind you, I am not sure if the Portuguese can, afterwards, forbid any Scotland Yard "blockbuster productions" in Portuguese territory on behalf of the McCanns.

    No allegations made. I believe (sometimes I doubt) the beautiful couple will, eventually, be reunited with their lovely daughter. Seriously.
