McCann's Lawyers admit to take legal action to other media outlets for slander, including the Portuguese ones

Process against Tal&Qual is ongoing



The lawyers of Kate and Gerry McCann are analysing what the worldwide media, between them the Portuguese ones, as said about them and the role of the couple in the disappearance of the daughter Madeleine to establish if there are basis for new processes of slander. The McCanns admit to prosecute other media for informations that associate them to the death of the daughter or that attack their character, as they did already with meantime extinguished Tal&Qual, whose “ (judicial) action still exists and it will be carried out to in time ”, confirmed the spokesman of the McCanns to PÚBLICO.

Yesterday, in the sequence of a process for slander moved by the McCanns, the newspapers Daily Express and Daily Star settled an agreement out of court and apologized to the couple, in their front-pages, because of having suggested that they would have provoked Maddie's death and cover up the fact. The Express Group, owner of the newspapers, paid as well 697 thousand euros in compensation of libel damages, which will revert for the Find Madeleine Fund (the amount will likely double the fund). The newspapers, with a joint circulation of around 1,4 million examples, will publish apologies again in their Sunday publications.

The spokesman of the couple, Clarence Mitchell, was yesterday in the Court of London, where the agreement was formalized and stated that the publications agreed that the articles in question, published throughout the last months, were “absolute pretences”. The couple expects “that the Portuguese authorities lift their arguidos statute in the very near future so that they can all focus in finding” Madeleine.

Now, “ the lawyers who are working with the McCann are analysing the whole media covering, past, current and future, in all the countries ” regarding the case Maddie, told Mitchell to a PÚBLICO. “ This is not a threat, it is only what we are doing”, he underlined.

Besides the process against Tal&Qual, relative to the front page of 24th of August which declared that the Judiciary Police was certain that the couple had killed accidentally their daughter, the team “maintains that all the options are in the open ”. But the couple has “more important things to be worried about”, says Mitchell. The McCann regret that this news has diverted attentions of their objective -to find the daughter, disappeared on the 3rd of May of 2007 from Praia da Luz, in the Algarve.

Two British tabloids said that the apologies are "sincere" and that “there was not any proof that was supported the theory” that the couple was implicated in the death of the daughter. Roy Greenslade, professor of journalism at City University London, commented to the BBC that for newspapers to carry front-page apologies at the same time was "unprecedented” in the United Kingdom. And emphasized that, “when people realise that more than 100 stories have been complained about as being grossly defamatory, it will annihilate the Express' readers sense of trust and credibility in their newspaper.”

About the Tal&Qual

Tal & Qual (pronounced [taliˈkwaɫ]; loose translation: Just Like That) was a weekly Portuguese tabloid newspaper, established in July 1980, that was published on Fridays. The newspaper was part of the Controlinveste group. Its last edition came out on 28 September 2007. The paper closed because of a drop in circulation, down from over 21,000 in 2004 to 13,000 by the end of 2006.

On 31 August 2007, the parents of Madeleine McCann announced that they were suing the newspaper for libel after the newspaper reported that the "police believe" Kate and Gerry McCann killed Madeleine, suggesting she may have died in an accident or from a drugs overdose. The police stressed that the McCanns were not suspects (at the time: they later became so), but Tal & Qual stood by the story. The journalist who wrote the article, Catarina Vaz Guerreiro, said "I can't reveal my source, but I have complete trust in them. I strongly believe that the person that gave us this information is telling the truth.

When this period of time ended, if Kate and Gerry McCann did not used « their right to reply or submitted any criminal complaints », they can only expect that the Portuguese newspapers are obliged to publish apologies - as it happened with two British newspapers- but only, « if they resort to civil actions and if it is proved that the newspapers and the journalists acted with liability ».

  2. Instead of worrying now about their daughter they should have done that before. THey deserve to be prosecuted. I get really angry at these 'Do Gooders' supporting the parents, as if they have done no wrong. PLEASE, how many more times does it need to be said, What is correct and loving parenting by leaving 3 young children ALONE in a room, in a foreign country, while you go out to the 'nearby' tapas bar to enjoy YOUR holiday. If they wanted peace and quiet they shouldn't have had children - then maybe poor little Madeline would be safe now
