The reconstitution was rendered unfeasible by obstacles that were created by the McCanns and their friends

Kate and Gerry lost the opportunity to prove that they had nothing to do with the disappearance of their daughter, Madeleine, when they and their friends rendered the reconstitution of the evening of May 3, 2007 unfeasible.

The conclusion is drawn by the Public Ministry (PM) that, in the dispatch that archives the process, admits that the “main damage” that results from this attitude was for “the McCann arguidos”, who “lost the possibility of proving what they have been protesting since they were made arguidos: their innocence regarding the fateful event”.

The PM admits that the investigation “was damaged” due to the fact that this diligence was not carried out and explains that, if the reconstitution had taken place, “it might eventually set aside, once and for all, any doubts that might subsist concerning the innocence of the missing child’s parents”.

Explaining that what was requested was the clarification of “failures to meet and lacks of synchrony, when not divergences”, which were detected during the analysis of the set of statements that had been given, which needed to be “tested and linked together on the location of the event”, the two magistrates that are responsible for the dispatch then explain what they wanted to see clarified.

The first doubt concerns the physical proximity – real and effective – between Jane Tanner, Gerry and Jeremy Wilkins (the movie producer who played tennis with Gerry during the afternoon of Mat 3), at the moment when Jane passed them by, and which coincided with the sighting of the supposed suspect, carrying a child.

The PM admits it is “strange” that both did not see Tanner or the alleged abductor, despite the smallness of the space and the coincidence of the time at which allegedly the three crossed ways.

According to the PM, the reconstitution would also serve to understand in what state the window of the bedroom where Madeleine and her twin siblings slept was, given the fact that Kate guarantees that it was open. “It was necessary to clarify whether or not there was a draft, given the fact that movement of the curtains and pressure under the bedroom door are mentioned”, the PM sustains.

Another doubt is related to the checking of the children, “given the fact that, if it can be believed that said control was as tight as the witnesses and the arguidos describe it”, it would be, in the magistrates’ opinion, “very difficult to reunite the conditions for the introduction of an abductor in the residence and the posterior exit of said abductor, with the child, through a window with little space”.

It also remains unclear what really happened between 6.45 p.m. and 10 p.m., when Kate alerted to the disappearance.

The possibility of a reconstruction in May was raised in mid-March. The exchange of emails that was started on March 20 between the coordinator of the investigation, Paulo Rebelo, and the English policeman who made the liaison with the McCanns and their friends, the will to be present was noticeable, but also the imposition of conditions.

The seven friends wanted to know how it would be carried out and “conditioned” their presence to the PJ’s answers. “We need a good reason to convince us”, writes Rachael in one of the many emails that were transcribed into the more than 50 pages that are fully dedicated to the exchange of correspondence between the PJ and the witnesses.

    Yes, I do think the McCanns missed the opportunity with the reconstruction and that alone left more than the other millions of people that did not believe their 'abuction' story.

    I think the reconstruction would have been their downfall, because of the inconsistencies and lies.

    I also think that Madeleine is no longer here on this earth.

    Perhaps with people around like David Payne, Matthew Oldfield and perhaps even her parents, she is better off where she is now.

Rachel Fucking Oldfield should hang her low life head in shame, who the hell does she think she is saying "We need a good reason to convince us" Isn't finding out exactly how and at what time Madeleine was taken and who was where at the time good enough reason? What more reason could the bitch want?
    The only reason they can have for refusing to do the reconstruction is because they all know full well the abduction will prove them to be liars and it will prove if their checks were as frequent as they have said an abduction by stranger almost impossible.
    It isnt only the McCanns who have to live with this, the friends too have blood on their hands, they have made certain Madeleine will not get justice or any dignity even in death,thats a pretty low thing to do. All of those present at the Tapas have children, one day their children will know the story of poor little Madeleine and hopefully they will ask some uncomfortable questions of their parents.Its also possible that their children will live with the stigma of who their parents are and as we all know children are the harshest critics and very cruel, their children could hear some pretty horrible things from their pers.
    More people disbelieve them than believe them, they are despised and loathed. I was surpised whilst sat up the Park with the kids, when two young children about 8 years old came over, I was reading an article about madeleine, one of them pointed at the picture of her and said " Thats Madeleine, her parents beat her up in her hotel room while she was on holiday and she died, they threw her body in the sea" I was startled, it was inapropriate to put them right on the story but it struck me, this is how the next generation of young adults perceive the Madeleine story.
    I would not want to live with what that lot haveon their consciences.

  3. if they had not failed her by leaving her alone in a strange apartment in a strange country to go drinking with their "friends" she would not be missing and probably dead and we would never have heard or the poor girl.
    They act like victims when in fact they, by leaving her and their other children alone and in danger, are the cause of this whole sad case.

  4. I'am disgusted today at what has been writen in the news in Britain today. Clearly the mccanns have protection from above and the dirty work of their spin doctor is doing the rest; i think they will never be brought to justice. Sadly.
    I would like to thank Joana for all the work she does on here and my only hope is that the British Pubblic will not continue to succumb to this rubbish being pished into their brain by the Media. Disgrace.

    KATE and Gerry McCann rowed and slept in separate bedrooms the night before daughter Maddie was snatched from their holiday apartment in Portugal.

    Evidence in the police files released earlier this week says that in an interview on September 6, Kate, 40, told detectives she was angry with her Gerry because he had ignored her during dinner at the Tapas Bar restaurant.

    The astonishing claim came as a letter to Portuguese cop Paulo Rebelo was also released in the files, in which Kate begs for the police to join forces with her and Gerry in the hunt for Maddie.

    On the night before Maddie disappeared Kate slipped off and slept in the children's room with Maddie, then three, and twins Sean and Amelie, then two.

    The witness statement reads: "When asked if she ever slept in Madeleine's room, she said that happened on Wednesday because she had fallen out with Gerry after he ignored her after dinner when they went to the tapas bar.

    "This only happened on that day. She decided to retaliate by sleeping in another room in the bed near the window.

    "She does not know whether Gerry was aware that she slept in the other room as he was already asleep when she left.

    "If in fact her husband was aware of this situation, he did not comment on it."

    Mrs McCann also told police that Madeleine slept in the room she and her husband occupied on May 1 last year.

    Clarence Mitchell, the McCanns' spokesman, refused to comment on the contents of the witness statement.

    The next night Madeleine vanished as her parents ate with friends at a nearby restaurant.

    Kate's seduction (probably the purpose, since they later objected to the reconstitution) letter to Rebelo is remarkable. Clarence might have written it. It has its style. It seems Rebelo didn't answer. If so Amaral shouldn't feel alone.

  10. Have had some experience of reconstructions which are big feature of Code Napoleon. Those I attended seemed more of getting all parties to agree what had happened. This resulted in the stronger characters convincing others they were mistaken in their recollections.

  11. I also have concern re the significance of sleeping in another room and not sitting together. If the reason for asking if she had slept in kids room was forensic-based, little point surely as she would have been in and out of the room many times. In the circles in which I move, husband and wife sit apart so as to be better hosts and to facilitate conversation. Is the suggestion that one or other killed the child because they had had a row?
