Defence for Gonçalo Amaral goes on attack

The former coordinator of the Judiciary Police of Portimão Gonçalo Amaral crossed paths again yesterday, at the Palácio da Justiça,in Lisboa, with Kate McCann, who demands in court for a indemnification of one million and 250 thousand euro. In question there are the alleged devastating effects caused by the publication of the book 'A Verdade da Mentira' [The Truth of the Lie], written by Gonçalo Amaral, in her family life and in the searches for Maddie that have [subsequently] ceased.

In the session two witnesses were heard, called by Kate's defence, a psychologist and a lawyer. Seated in an enormous bench, spaced with 10 meters of emptiness between them, Kate and Gonçalo Amaral never looked at each other. But Kate McCann, during one of the morning breaks, managed to see on his way out of the courtroom the former PJ inspector signing a book at the request of an elderly man that was there following the session.

 Santos de Oliveira, Gonçalo Amaral's lawyer, also signed the book at the request of the elderly man. Minutes later, the lawyer, on his way out of Palácio da Justiça, gave an impromptu press conference. He said he would only talk because Kate McCann had done so outside the court session on Thursday.

The lawyer said that the book was written with information contained in the criminal inquiry [to Madeleine's disappearance] and that the trial that is now taking place is about the crime of expressing an opinion [original: delito de opinião]. “There never was any formal criminal complaint and I find it very odd that one year had gone by since the publication of the book until a complaint for compensation was made, said Santos de Oliveira, who also recalled that Madeleine McCann's death “is considered as an hypothesis in the archiving dispatch” [see bellow relevant extract]. Santos de Oliveira also told that they had requested for the trial to take place behind closed doors to respect Maddie's memory. The child's parents were the ones who preferred a public trial.

Santos de Oliveira, Gonçalo Amaral's lawyer (00:15): Amaral has the right to publish the book because he hasn't said any lie. And he hasn't offended the personality [rights] of the McCanns or of Maddie McCann, or of their children. What he said lies [is contained] in the criminal case [process/investigation]. He has based all information that he said [used] which are in the criminal case, all of them! All of them!

It's not a thing that he has imagined, okay? He made a conclusion, the book is a conclusion about the criminal case and it's his opinion as an investigator. And if this is wrong then we have to ask the prosecutor that says there's a probability the child is dead.. the most probable... all the things indicate that the child is dead.

We asked to the court to deal with this trial behind closed doors to protect anything about the disappearance of Maddie McCann, because we don't know if the girl is dead or alive. And we asked that, the McCanns opposed that [request] and want the publicity of the trial.

  1. Thanks a million dear Joana - lovely to see you back hope you are well. All the best to our friends in Portugal especially to Amaral as he continues in his fight for Madeleine and her rights to be heard. God Bless him he is greatly admired for standing up in the name of truth.

  2. The trial seems to be about vindication, retribution and compensation. Let's us also remember that the book was only published AFTER the final conclusion that the case should be achieved\shelved, therefore in no way did it cause any damage to the investigation in seeking Madeleine.

    After all, hand on heart I believe this little mite is dead, probably never saw the sun rise on the morning of May 4th. But I'll never stop looking and bleating on until the case is solved.

    Rather like the UK case of April Jones, who was abducted October 2012 and a man convicted of her murder was jailed earlier this year. Everyone still continues to look for her, since her body has never been found. Without any possibility of her being alive, there's always hope. But equally the need to be realistic.

    If the verdict goes any other way than to him - then there has been no justice.
    The Law should be above money and status ....for god sake people wake up, are you all numb sheep wondering which way it will go.
    If you support Justice there is only one true verdict!

    It does upset me to see the toll it has taken on All involved, it is clear that on both sides the immense pain and stress this case has caused and no humane person likes to see others in pain.

    However the Mccanns chose to attack Goncalo even though he was working for the interests of the real victim in all of this "Madeleine" just in case anyone had forgot about her.

    The reality is that it never needed to be this way if the truth had been told from the beginning, but instead a cock and bull story was given that did not add up... and has the investigation followed the leads, not hearsay but real leads - a different story was emerging....one that the McCann's did not want following because it implicated them and some sinister events, a far cry from the account they had initially given and changed in parts along the way (to dodge other crimes like neglect ),they then refused to act out their latest version story/statement in a reconstruction.

    They have lied and lied and shown a side to them in their vengeance against Goncalo Amaral that has dampened my human feelings of sympathy and allowed me to see them for what they are.

    If the verdict does not go Goncalo's way - I beg you all to not let this rest as just another travesty of Justice....but to use it as the reason to fight further for the sake of what is Right and Just.

    Madeleine deserves that.


  4. It worries me that the McCanns would want the trial to be open to the public. I might be reading to much into this, but it seems to me that they have been assured that they will win.

    It's strange that you have Mr. Rogerio Alves saying that no one believes that the parents were involved in the disappearance of the child, and yet the McCanns are claiming that the people have stopped searching for the child because of Mr. Amaral's book.

The fact is, he lives alienated from reality, from day to day life, stuck in his plush office - just go to the streets, coffee shops, speak to any person that has lived in Portugal for the past 6 years and has forcefully followed the case, and 9 out of 10 will be of the opinion the McCanns had something to do with Madeleine's demise, not because of Amaral's book, not because of the Doc that was broadcast by TVI, but by the McCanns own actions, the most recent one being the last drop for many. Yeah, SY were wise to advise the McCanns not come to Pt, but the McCanns still think they they can play this one out in their favour, in terms of media and publicity. BTW, what Amaral and his defence proposed was not a fully behind the doors closed trial, ordinary members of the public could still attend, only the hacks and journos wouldn't be able to. Again the zelebs preferred the media spotlight instead of the preservation of Madeleine's memory, or life is she's still alive, much like when the McCanns publicized and highlighted her eye blemish in several marketing campaigns and merchandising products, when they were advised by cops not do that.

  9. I can see through their manoeuvring ...you see the Mccanns want the case closed and I think they are positioning their options.

    It would be easier later to arrange for another girl to be found who they would say is madeleine - the problem is because the condition (coloboma) is rare, then it makes it much harder to find such a substitute for Madeleine. If they can take the emphasis away from the eyes .....then they can use another girl who of course will not need to resemble Madeleine so closely because of the age now.

    Can you imagine the furore of a later found madeleine and the press reaction.....don't think this is not possible.

    think about it ......do not put anything past them or their supporters .....It is easily possible and I believe an option they would not think twice about using.

If he really doesn't understand that a coloboma, however small and of such minimal severity that it does not affect her vision, is a permanent genetic defect, he jolly well should as a doctor. It is NOT merely about a different colour in the iris, it is about a defect in the iris, and large or small, it is a permanent one. Either she had such a coloboma or she didn't.

I have found that all the information contained here within to be most interesting and I pray that justice be done for this person who wrote the book ,for I believe he wrote it in truth as a man how had worked for 0ver 25 years on matters /cases, such as presented in his book and knew his work inside out as we say. Now he is being subjected to being dragged through the court to appease the greed of the other party who say the search for their daughter has been hampered by his writings. I would say this is lies and I believe they used and abused the public monies sent to fund their daughter search by using it to pay others to do the searching and then sacking them in the process only to use the money for their own ends. Is it the fact that the searching was stopped years ago and they have near run out of funds, so by going to court is it really not about the book but another way to put funding back in place to cover what they have misused.   12. I believe the writer of the book did so to make people aware of just how important was the work carried out by himself and his team not just on this case but on all cases in their charge. He knew that there was flaws in the statements given at the time of Maddies mystery vanish into thin air, he knew that it was time to set the record straight once and for all. Remember this was a man who had over 25 years expertise in this field , he had nothing to gain from writing lies as his own team could vouch for what he found in the villa , also there was the two search dogs ,surly they cannot be in the wrong too. This case against this man should have never been allowed to come to court and I can only see the reason for doing so as a way of putting money into the near empty search maddie fund, which I understand has been used for other purpose as well. I pray that justice be done in court for this man in due course. ps. the searching for maddie ended a very long time ago due to doubts about this case, the money from the public was used to cover in part their own needs , and to pay search people who were I believe were sacked the money was wasted in the process. There is so much I could say but I think it best to leave well alone at this point in time.

  13. Anonymous 15/09/2013 14:35 Look at those statements again, doesn't the statement by Mrs. McCann where she says that they never put that much emphasis on her eye surprise you? They did put a lot of emphasis on the appearance of her eye did they not?

    My theory as to why they are now downplaying the appearance of the child's eye is because they are trying to obscure Mr. McCann's statement that they used it as a marketing ploy. Something that is mentioned in blogs such as this one. You see these people read these blogs; they are obsessed with counteracting any snippet of information that puts them in a bad light. I recently posted a comment in which I mentioned how team McCann's timing has been impeccable and how terrible the timing was for Mr. Amaral that SY was in Portugal declaring that the McCanns were not suspects and that there was no proof that the child died. I also commented how this occurrence probably put Mr. Amaral in a bad state of mind. Sure enough a day or two later an article appeared saying how bad the timing of the upcoming libel trial was for Mrs. McCann and how terribly distressing it must be for her. Coincidence, I don't think so.

  15. Joana. I need to know two things about Portuguese law.

    1 - Firstly I assume I am right that UK superinjunctions, if by chance there should be any related to this case, would only affect reporting in the UK. Right? It would not stop newspapers or bloggers in Portugal reporting information which emerges.

    2 - Portuguese libel laws. I have said before - UK libel laws are appalling, and the country has become known as 'the libel capital of the world', with cases that should rightly be held in the US, where the libel laws are more sensible, being somehow transferred here. What are the libel laws like in Portugal? Who has to prove what to whom?

  16. So Mrs Hubbard said in court, reportedly, that the McCanns were "angry" about Snr Amaral's book, and that it turned public opinion against them. But what about being made Arguidos? How do they know that is the reason the public turned against them? Have they asked the public whether it was perhaps their own behaviour of leaving their children alone in an insecure apartment that turned the public against them. Where is the proof of what turned the public, if that's what happened. How do they know it was not the local Priest who said he was betrayed who influenced public opinion? How was the search damaged when there were so so many sightings all over the world? and so many private detectives working, and now Scotland Yard? Oh please, come now!

    There are no coincidences my friend! It is all embedded and/or being orchestrated from behind the scenes.

    I also believe Scotland Yard's intervention - by order of David Cameron (...) is, quite aside from a clever "reputation management" move, an attempt to influence the Portuguese judges against G. Amaral in a first instance and (at a later date) the European Court of Human Rights.

    The strategy may or may not succeed. We shall have to wait to see (...)

    Also, we do not know if this judge is pro-McCann or pro-Justice. We have seen in the past that Isabel Duarte has a knack for picking up the judges that will play her way. Unfortunately she crashes when her cases go to an Appeals Court. Senior judges are (usually) not fools (...)

    Now, it may be different this time because Lady Melo e Castro is not stupid (my assumption) and knows what will happen at an Appeals Court if she rules in favour of the McCanns. That wouldn't be very nice for her reputation as a judge (...)

    Coming back to Mickey Mouse. Clarence is based in the UK and it is most unlikely investigative journalists here will expose the plot for fear of being "carter-rucked".

    Also, the British are extremely parochial when it comes to defend their own citizens. An attitude the Portuguese, seemingly lack - or Amaral would never be in Court AND the McCanns (together with some of their friends) would have already served time in jail for abandoning their children to their fate, obstructing the course of justice, etc.

Yes, Scotland Yard's presence in Portugal and their public declarations is an attempt to influence the judge, as I've said the timing is impeccable.

    This libel case against Mr. Amaral should have been dismissed. The libel case became a non issue when the appellate court validated Mr. Amaral's book and rebuked the judge who had banned it and ,even more importantly, when the supreme court upheld the appellate court's decision. The fact that this fiasco has even proceeded to trial is worrisome. It could be an indication that we could possibly witness once again one of those jaw dropping decisions.

    I came across a paper in a library that featured successful local entrepreneurs. One of these entrepreneurs, Keith Bilous, is owner of ICUC MODERATION SERVICES the largest company in the world doing online content moderation. The staff of this company, quote, "sits in front of computers 24/7 monitoring millions of social media conversation, comments, photos and videos in order to protect their client's brand and ensure that hateful and rude online comments never make it onto their websites and damage their reputations. That is the world we live in.

    Here in London we also have companies advertising "on-line reputation management" (on LBC radio for example).

    If you read Burson-Marsteller .pdf on "E-fluentials" you will have all sorts of lights flashing... well, I did.

    The "coincidences" did puzzle me for a while, it was apparent there was some kind of marketing hand behind them until I digged a bit on Clarence Mitchell's Burson-Marsteller business. Bingo!

    Also consider what kind of political acquaintances (and influences) a man like "Mickey Mouse" has (...)

    Remember, he was the Head of Media Monitoring of Tony Blair's government ("Iraq has weapons of mass destruction!") and it was Blair's successor (Gordon Brown) who dispatched him to Portugal to spin for the McCanns'. He quickly found out Gonçalo Amaral had "weapons of mass destruction" as well... :c

    Lots of conspiracies have sprung out as a result of his assignment but, probably, it was all down to Ideology (Althusser) and the fact both Gordon Brown and Gerald McCann (Gerry) were born in Glasgow. They are both Scots.

    Clarence Mitchell however, is not Scott. He was born in NW London but is surname is derived from the Irish-language Ó Maoil Mhichíl, meaning "descendant of the devotee of St. Michael". There you have an Irish connection (same as Gerry).

    Not clear why, Mitchell leaves the Civil Service and becomes a spokesman for the McCanns', except he may have seen in the job a way to get much needed media exposure necessary to further his career.

    In a sense, it is in his CV interest that he keeps the McCanns' in the limelight and that HE, in the end, wins. How much Scrooge McDuck (Kennedy) is paying him is open to speculation. May be the Fund pays. Who knows!

    Anyway, after leaving the Civil Service, Mitchell did become Director for Burson-Marsteller after a stint as a consultant for Freud Communications both of which paid him more, much more, than what he used to pocket as a Media Monitor for the government.

    It is not by chance he is known to British journos as "Mickey Mouse" (...)

    Important to note in the context of David Cameron/Scotland Yard initiative, that Clarence Mitchell is now a candidate member (as MP) for the Conservative party of his mentor David Cameron (...) which makes it much easier to understand everything you write about Scotland Yard "reputation management".

    What we have here is: gold digging on the one hand, and British imperial ideology and hegemony on the other. They think the Portuguese have no right to judge British citizens. No one has! Not even drug smugglers and murderers!

    One aside:

    Whenever Portuguese consumers buy into British music, writing, etc. they are buying into their ideology! Their are giving their power away and contributing to theirs.

    In British radio (for example) you don't hear a song which is not in English (except in rare niche programmes of the BBC). Tune into Portuguese radio and tell me what you hear. Then ask yourself how it come to this (...) Anyway I digress.

  24. I agree with so much of the posts accept when you generalise with the word British. It gives the impression we are all the same, I hope you don't believe that !
    Just the same as I don't think all you Portuguese are like some of the Portuguese hierarchy working against their own citizens...think about it !
    Britain does not do for all of its citizens what it has done for the Mccanns....that is a huge aspect of this case - have you forgot that! in fact it doesn't care a damn for its general public but that's another issue.

    This is about a connection, a network that is looking after its own - the network has no allegiance to any country/s just its circle.

    Back on track ...lets see what happens in the Portugal Court...Has a country sold out ..condemning an innocent man who has the truth on his side whilst its citizens sit idly by ....lets observe.

As Snr Amaral's lawyer implied outside the court to the press, why do the McCanns want the hearing to be public, when what is revealed in court will be that the PJ investigation included evidence of the death of Maddie? This when the McCanns claim that the investigation suggestion that Maddy died, hindered the search for her? Mr McCann said at Leveson that he was happy to hear theories about the case, so why not the credible theory based upon the factual evidence of the PJ and British investigation at the time, described in the book?

    The Scotland Yard's presence in Algarve has nothing to do with that libel hearing. Besides the PJ would not have accepted it. They are not stupid, are they?

    The Met police are doing a serious work. I understand that Portugal lost its confidence in the UK but not all of the government Britons are corrupt.
    The McCanns have lost their power after the News International and the News of the World scandal. I even am convinced that they were victims of an ambush, built up by Rebecca Brooks.
    She blackmailed Cameron to involve the Met police in the case, after Kate's book had exhausted the issue.

    Next stap: arrests, trials which will sell millions of extra papers.
    That was her goal.

    You speak of Scotland Yard doing serious work, just what exactly is this so called serious work? Is it Mr. Redwood doing the rounds of the morning talk shows telling us about the 195 leads and repeating that the McCanns are not suspects? Is it Mr. Redwood starring in a documentary looking into the camera with a Mona Lisa smile and alluding to the incompetence of the Portuguese police much like an actor in a Monty Python sketch, “nudge, nudge, wink, wink, say no more, you know what I mean”? Who do you think benefits from Scotland Yard being on Portuguese soil declaring that the McCanns are not suspects and that their Tapas friends will not be interrogated? How can any investigation be taken seriously when the people who last saw the child are ignored?

    The only serious work that Scotland Yard is doing is serious Public Relations work for a couple of malignant narcissists. We’re not stupid we have followed this case for over 6 years now. We’ve witnessed British politicians accompany parents, suspected of harming their child, to the European parliament and promoting them as champions of a child welfare initiative. We’ve seen a British judge in court making a heartfelt appeal to that elusive abductor. We saw Mr. Leveson devalue the work of the Portuguese police by referring to the contents of the case files as being fluff.

    What can be said about a country where you cannot express your thoughts on an issue? Is it a democracy?

    Rubbish, The MET are there to help the McCann case and anyone who cant see that are blind.
    They haven't even bothered to recall the main suspects of the investigation - They are there on Government orders to get this case cleaned up and put to bed with the result of clearing the McCann's.

    Not All British are corrupt absolutely true.....but in the positions of influence within the country most are.....and everyone working on behalf of the McCann's have been corrupted!

    If you look Deeper you will find in this case.. and I am just been factual - that many of the main players have Irish and Scottish connections .....certainly in the political spectrum as well as family.
    So I Guess "British" is a useful generalisation to put you off the scent of the true roots of connection in this case.
    Does anyone know any groups or brotherhoods associated with Catholicism.....Wake up people, Don't be afraid to say what you see, sometimes fellowship is found under the name of religion/ideology, the groups become formed and network across the world, they are a circle a "tight" family.

    Look I am getting fed up of all you clearly clever people here avoiding what is really going on with this case.
    Have you all become so sheep like that you are scared of the truth?

    Can nobody other than myself really see that for this case to have gone the way it has, that there is a network of influential people steering the case......come on folks get real, open your eyes and look it in the face.....it cannot be beat by crossing the road.


  29. I am following this trial with great interest after reading Snr Amaral's book in its abridged form. I believe that the compelling evidence he has presented following the PJ investigation certainly leaves the McCanns with a case to answer. However, it is obvious that they are well connected and protected. Whether that will be sustained when the money runs out remains to be seen. I wish Goncalo Amaral and his team the best of luck, and sincerely hope that truth will out in the end. And, especially that there is justice for Maddy

  30. i agree with 29 however since the early days of this case i have never changed my opinions about the final outcome of this case... way back then on the daily express forum i made the following prediction ...before this ends it will be a far sadder story than now... the mccanns have as their opponents this the internet which is a formidable ally of those on the side of the truth

  32. I hope that the court rules in favour of the policeman Snr Amaral. I do not believe that his book influenced people to stop contributing or looking for Madeleine. This man was trying to find her. The parents stood in the way of getting to the truth. Why would that be? I sincerely hope that the truth will come out and justice for Madeleine will be seen to be done.

    I am British! The British people on the whole want justice to be done. In this case as well as for Madeleine.

  35. I have a coloboma. I was born with blue eyes, with a brown fleck, as I got older, my eyes went green, but the brown fleck is still there and I look like I have 2 different coloured eyes, so in the case of Maddie, her eyes will always be the same, with this noticeable defect, regardless of her age. It does not affect your vision, it is just a defect in the iris.

    These defects don't change, they stay the same, so they emphasise the condition in the initial publicity in the UK and now they are trying to pull back from it being a big deal.

    Two shady people who have something to hide and always come out on the attack, to protect themselves, yet showed little sign on wanting to help with the original investigation.
